Today in the Parliament of Albania, Chief Prosecutor Olsian Çela reported on the work of the Prosecutor's Office, who did not escape Gazment Bardhi's question regarding the Xibraka file.
Bardhi addressed him, saying that he himself, as the prosecutor of this file, left without investigating the heads of what the head of the parliamentary group called a structured criminal group.
Gazment Bardhi: Leave those who are known as the heads of this criminal group uninvestigated. In your instructions, do you recommend this standard of investigation to your subordinates in the district prosecutor's office. And secondly, should deconspiracy be investigated, do you recommend it to your subordinates?
Olsian Çela: I will refer to what the leader of the session said that this is a report on the work of the prosecution for the year 2023. It is my duty as the general prosecutor and your duty as a deputy to adhere to the constitutional and legal framework that ensures the handling of this case reporting in the interest of citizens.
Asked by Bardhi about the confiscation of illegal constructions in some towers in Tirana and on the coast, Çela said that some cases have been sent for trial.
Bardhi further told Çela that he is paid in vain if he does not have this information about the files.
Bardhi: Unauthorized additions to towers and tall buildings in Tirana and the coast have been denounced, this was then confirmed that a suspicious procedure of confiscation and sale to the same people who built them without permission was established. You told me you have no information... you are paid for nothing as a general prosecutor. How many of these who build towers in the middle of Tirana and no one sees that they are building floors without permission have been prosecuted by the prosecutors.
Çela: Regarding the issue of constructions without permission, it is a matter treated more seriously by the prosecution. I have asked them to treat it with maximum attention. It is quite disturbing that we suffer from the phenomenon of illegal constructions. You have submitted a request for these matters and we have clarified that they are general information. I can tell you that during 2024 the prosecutor's offices have sent a part of these cases for trial.
Xibraka file
Olsi Rama, the brother of the Albanian prime minister, appeared last week at SPAK regarding the re-opening of investigations into the drug laboratory discovered in Xibrakë in 2015.
Gazmend Bardhi accuses Olsi Rama, the brother of Prime Minister Edi Rama, of being associated with a criminal organization of international cocaine trafficking in 2014 and called on the Prosecutor's Office to reopen the investigation to verify his role in the well-known cocaine laboratory file in Xibraka.
Bardhi referred to the documents of the Prosecution of Serious Crimes and the data of the TIMS system to prove, according to him, the fact that Olsi Rama used the same car during 2014 as the other convicts of the "Xibraka" file, where the police discovered at that time a cocaine processing laboratory in the village of the same name.
According to Bardhi, the connecting thread between Rama and the other members of the group was the car with license plate AA 653DM, used by them and registered in the TIMS system at the entrances and exits of the country.
The TIMS documents made available by Bardhi show that Olsi Rama entered the territory of Albania three times with this car on June 8, 2014, July 13, 2014 and August 8, 2014; respectively from the border points of Kapshtica, Qafë Thana and Qafë Botë.
The same car was used several times by Gentian Gjonaj from April to November 2014 and by Ermal Hoxha, the grandson of former dictator Enver Hoxha, in November 2014.
According to Bardhi, the prosecution and the Albanian court have accepted that the convicted persons are not the only persons who were involved in this criminal activity, but an investigation into the unidentified persons has been closed further.
In March 2016, the Prosecution of Serious Crimes separated the proceedings for the unidentified accomplices, which according to Bardhi was only one, dictated by the surveillance services as the driver of the above car and described in the prosecution documents as "45-year-old with short hair".
The investigation into the group involved in the cocaine production laboratory in Xibrakë started in December 2014, after the information arrived in Albania by the German authorities. In January 2015, the Serious Crimes Prosecutor's Office indicted 9 people for drug trafficking and the creation of a structured criminal group.
The Prosecution of Serious Crimes accused Genci Xixa of being the leader of the criminal group involved in the cocaine laboratory, but he was never arrested by the police. The members of the group were sentenced to 104 years in prison by the Court of Serious Crimes, but the sentences were reduced on appeal and some of them, as in the case of Ermal Hoxha, were released earlier for "good behavior".
According to the head of the DP parliamentary group, Gazmend Bardhi, it is not known what happened to the separate secret file with the person unidentified by the police. Bardhi asks the Special Prosecutor's Office to provide an answer to this.
"There are so many facts, circumstances and indications in the poorly investigated file of the prosecution, that the justice has the duty to reopen the file immediately," said Bardhi, calling the head of SPAk.
