Berisha and Rama on the same page, there is no re-candidate for Altin Dumani and the other SPAK prosecutors...

Sali Berisha has " winked " at Edi Rama for the SPAK sub-election. For 3 years, the Special Prosecution Office has made a request to the Assembly to make constitutional and legal changes in order to give current prosecutors the right to re-election.

Article 148/dh of the Constitution expressly states: “ The Special Prosecution Office shall consist of at least 10 prosecutors, who are appointed by the High Prosecutorial Council for 9 years, without the right to reappointment .” So, a large part of the current prosecutors (about 10) must leave there in 2029. The rest will leave in the following years, as they were appointed late.

Altin Dumani said it today in the KLP and has stated it several times that they demand that he be given the right to run again.

" The problem remains the continued lack of a clear legal definition regarding the status of special prosecutors after the end of their mandate. SPAK notes that this issue has not yet been addressed and emphasizes that the lack of a clear definition of this status may undermine the continued maintenance of high professional standards of investigation, required by the public, the Parliament, the Council of Ministers and international institutions. As highlighted in SPAK's annual report for 2023, the lack of a clear status of special prosecutors would also undermine the continuity of important investigations conducted by SPAK ," Dumani stated.

The EU has even floated the idea that the president should also be entitled to another term, as the law states that the president has a 3-year term and does not have the right to run for re-election.

But this request has been on the shelf for 2 years and Edi Rama and the majority have never bothered to address it. Today, Sali Berisha came to your support, stating firmly that the DP will not accept a constitutional change regarding the mandate of prosecutors.

" This guy is obsessed, in every meeting he demands: 'Change the Constitution for my chair.' No, sir, we will not change the Constitution for your chair. Yes, the Constitution will change, but to remove the prosecutor's right to control the judge in the case ," Berisha said.

So, both Rama and Berisha are now together. In December, Altin Dumani's term as mayor ends and if there are no changes, he will have to hand over the post. Most likely, they will appoint someone closer to politics.

Meanwhile, after 4 years, the negotiations for the appointment of prosecutors will begin and SPAK will likely end up as a normal prosecutor's office, since politics no longer allows for the appointment of honest and law-abiding people. SPAK may indeed continue to have the name, but it will end up like the Anti-Corruption Unit for Serious Crimes that did not arrest anyone if the US does not take the situation into its own hands. /Pamphlet
