Edi Rama has brought Fatmir Xhafaj back onto the stage, signaling that the commission led by him will bring many tensions and clashes to the new parliamentary legislature.
After May 11, the socialist MP seemed to be left in the shadows and there were many dilemmas about what would happen to the special commission he led. But today there are signals that he has been working under the rug and in September we will have a new battle against justice and independent bodies.
In open violation of the law, after the Parliament was closed, Fatmir Xhafaj convened the committee today, submitting for consultation a new law on conflict of interest and a law on the financing of political parties.
The 2005 law on conflict of interest has been completely changed and restrictions are placed on MPs, ministers, judges, prosecutors, the president, the head of the Supreme Audit Office, and the heads of other constitutional bodies.
" This important draft law, which also coincides with an EU recommendation, is a priority law that the Albanian state must pass. We are assisted by the Council of Europe ," said Xhafaj.
So it seems that the pretext of EU integration will bring a series of new laws in September, including the revision of justice laws, allowing Xhafaj to target whoever he pleases.
Regarding this meeting, Democratic MP Jorida Tabaku reacted. According to her, this meeting is being held in violation of the constitution after the parliamentary session has ended, while she says that it is evidence of the majority's capture of this committee.
" Although the parliamentary session has ended and the permanent committees are no longer active, the majority has chosen to open the doors to unconstitutionality and illegality. In an unprecedented manner, a hearing has been called for two initiatives that have been held hostage by this majority for years: the law on conflict of interest and the one on political parties. And who else but the well-known Commission of Mr. Xhafaj would take on this violation? The call for this meeting comes at a time of institutional recess, in complete contradiction to the Constitution and the law. Albania today does not have a legal emergency that justifies the call of committees. On the contrary, the majority did not even manage to secure 71 votes for the approval of laws. But in order to maintain the political monopoly over the integration and reform processes, it finds unilateral ways and procedures outside the democratic norm ," writes Tabaku.
According to her, the Xhafaj commission has functioned from the beginning as a means of capturing the process by the majority; it has destroyed every principle of political cooperation, excluding the opposition and turning integration reforms into party property.
