Government: Minister enjoys the same immunity as MP
The government's arguments in the Constitutional Court regarding the appeal made against the measure against Deputy Prime Minister Belinda Balluku are being clarified. A few days ago, it was the Prime Minister who announced that he had addressed the Constitutional Court to lift the suspension from office of the government's number two.
In the request sent to the Constitutional Court, the Council of Ministers states that the decision of the Special Court to suspend the Deputy Prime Minister and the Minister of Infrastructure and Energy directly interferes with the competencies of 3 state bodies: the Prime Minister, the President, and the Assembly.
" The suspension brings serious consequences for the state and social interest by creating an institutional vacuum as it prevents the proposal of projects of national importance for integration into the European Union, around 800 projects to be approved by the end of 2027 by the ministry led by the minister, who has been suspended through the decision of the GJKKO ," the Council of Ministers reasons.
According to the government, Belinda Balluku could not be suspended from office, as in her capacity as a member of the government she enjoys the rights of an MP.
The government in its arguments refers to Article 103 of the Constitution, which expressly states:
1. Anyone who has the qualifications for a deputy may be appointed as a Minister.
2. The Minister may not exercise any other state activity nor be a director or member of the bodies of for-profit companies.
3. Members of the Council of Ministers enjoy parliamentary immunity.
In his reaction to the GJKKO decision, Prime Minister Edi Rama considered the intervention of SPAK and GJKKO to order the suspension of a minister to be wrong.
Rama said that the GJKKO decision is a manifestation of a completely new government and anti-democratic reflexes.
" The suspension from duty of a minister, in this case also the deputy prime minister, directly for leading the government is a manifestation of these weaknesses, of a completely new power and anti-democratic reflexes. A unique case in the history of Europe and in the history of special justice bodies that have been created in the integration processes. It has never happened that a prosecutor and a judge come together face to face and suspend a member of the government from duty."
"If a special prosecutor and a special court of first instance here in Albania have decided to suspend a minister, taking over the powers of a prime minister and the parliament from which the government's mandate originates, our choice in relation to this fact is strategic as always, to preserve and support the independence of the judiciary even in this extreme case ," said the prime minister.
