Korçë Municipality, otherwise known as Albania's record-breaking institution, is going through a golden period by winning two Guinness awards due to the recorded violations. The first for the fuel consumed by the director of the Public Services Company, Ilirian Dinellari, and the second for keeping the asphalt in the warehouse for 11 days without interruption, by the same person.
However, let's leave aside the violations by the director of the Public Services Company, Ilirian Dinellari, and talk concretely about the mayor's recent moves.
In an official order dated June 1, 2023, with protocol number 4284, Mr. Sotiraq Filo has transferred all powers to the Deputy Mayor of the Municipality, Mrs. Benila Themeli.
"To replace all the legal powers that are known to the mayor of Korçë with Mrs. Benila Themeli as deputy mayor of Korça Municipality for the period June 1, 2023 to December 31, 2023, excluding those powers and functions prohibited by law which cannot be replaced'.
So, for 6 months, the mayor Sotiraq Filo delegates the management of the Municipality to his vice-mayor. The Mayor of Korçë bases the delegation of powers on law no. 139 'On Local Self-Government' and on law no. 44/2015 'Code of Administrative Procedures of the Republic of Albania'.
This delegation is not supported by law. Delegation occurs only when the person is visiting abroad, or is ill. This delegation makes no sense and is not supported by the law,' says lawyer Edmond Petraj.
So, we are in administrative violation by the mayor, which can be considered up to abandonment of duty. Convinced of the naive collapse that the Korça Municipality may suffer, as always we set out with the good will to help its leaders.
Journalist Eraldo Harlicaj goes to confront him. Fortunately, we find Mr. Filo in good physical shape in the bar next to the town hall dealing with important city projects. Therefore, health reasons and visits abroad are immediately excluded.
'It is not true that I delegated it to him. You are not correct, send an official letter to understand. It is unethical of you to react like this and catch me in the bar. I have delegated only some powers to the vice-president Benila Themeli'.
We leave unclear with the answer given and act as the mayor asked us, asking for information about the delegation of powers to the deputy mayor of the Municipality, Benila Themeli.
The answer that comes back to us proves the problems that we have identified, since it seems that Mr. Filo was reminded of the detailed transition of powers only on September 25, the very day that we had the confrontation with the first of the institution.
The mayor has disposed of the order no. 980 dated September 25, 2023, on the basis of which the signature of the institution's outgoing correspondence related to evidence, accompanying letters and others of this nature and importance, as well as the unification with the original acts or other official documents of the institution, will be carried out by deputy President Benila Themeli for the period from September 25, 2023 to December 31, 2023'.
The difference between the two orders is clear, even Mr. Filo deserves to win the third Guinness award, but we hope that SPAK does not go before Piranja. / Syri.tv
