Even though 4 months have passed since the murder of Judge Astrit Kalaja in the courtroom, the Committee "On Civic Initiatives, Cooperation and Institutional Oversight" has launched an inspection tour to monitor security in the courts.
This inspection is being carried out in flagrant violation of the separation of powers. The only body that refused to cooperate with this commission to conduct inspections was the Special Prosecutor's Office.
" Any practice of conducting such monitoring visits would conflict with the constitutional independence of the Special Prosecution Office. This independence is not only a formal legal requirement, but also a fundamental condition for ensuring independent, impartial and efficient investigations, in the protection of the public interest and the rule of law. In the continuation of the inter-institutional dialogue and cooperation with the Commission, the Special Prosecution Office remains committed to contributing to the transmission of any necessary information in order to fulfill its constitutional and legal obligations ," SPAK stated.
But it seems that Fatmir Xhafaj's deputies "entered through the window". Although SPAK did not acknowledge their presence, they used the entrance of the Special Court to inspect the situation. The GJKKO and SPAK use the same entrance, even though they are located in separate buildings.

But the absurdity is how can a deputy visually inspect where security is lacking. How can a parliamentary committee send deputies to the courts and have them see with their own eyes where the problem is lacking? Security is done with projects and by security experts. It cannot be done by a few deputies in suits and collars who want to put on a show and send messages that they are above justice.
A few days ago, inspections were also carried out in several other courts. Saimir Hasalla and Aulona Bylykbashi went to monitor the Elbasan Court. For the Fier Court, Xhafaj has chosen a 31-year-old deputy, Erjo Mile. Bledi Çomo was also with him in Fier.
Xhafaj sent Onid Bejleri, a young MP with a construction engineer's profession, to the Shkodra Court. While the young SP MP, the son of actor Petrit Malaj, went to the Tirana Court.
This inspection of the deputies of the committee under the leadership of Fatmir Xhafaj shows a deeper problem in the relations between the powers. Instead of relying on legal expertise and procedures, some deputies seem to try to show their presence as “personal control” over the courts, creating a more symbolic than real effect on the security and functioning of justice. This behavior not only damages the image of the institutions, but also raises doubts about the respect for the separation of powers and the real purpose of the visits.
