A pure bargain in the heart of SPAK: how the stance on Ylli Pjetërnikaj changed for a single vote in the High Prosecutorial Council...
Prosecutor Ylli Pjetërnikajs was confirmed in office by Vetting Appeal.
A 180-degree change of course in the positions of SPAK leader Altin Dumani has raised the alarm for a clean sweep within the most important justice structure. The issue is related to the confirmation in office of prosecutor Ylli Pjetërnikaj, who was initially proposed for dismissal, but ended up being "washed" by Vetting, after an open maneuver by SPAK in the Special Appeals Chamber (SAC).
Numerous sources within the system and investigative publications by "Pamflet" reveal a tacit agreement: Pjetërnikaj's defense in the KPA was used as a guarantee for a decisive vote in the High Prosecutorial Council, in favor of the candidate for new head of SPAK, Klodian Braho.
Altin Dumani, at the beginning of the process, personally represented the position for the dismissal of Pjetërnikaj, relying on the arguments of Public Commissioner Florian Ballhysa, who requested the exclusion due to unjustified assets. But in the final phase, SPAK changed its position. At the decisive session, Dumani did not appear himself, but sent his representative, namely Klodian Brahon, who, on behalf of the SPAK leader, requested that the KPA leave the decision to confirm Pjetërnikaj in office in force.
This sudden “turn” came right on the eve of the KLP vote to elect the new head of SPAK. Pjetërnikaj is a close friend of KLP member Zeqir Hoda, one of the most important votes in this process. His vote could determine the winner among the four candidates, and this makes Dumani’s move not only suspicious, but also fraught with strong overtones of institutional corruption.
The Special Appeals Chamber closed the case with an unusual decision, "dismissing the appeal" and granting Pjetërnikaj final confirmation in office, without any analysis of the suspicious assets declared by him and his family members.
This is no longer a professional issue, but a political and moral one: will Zeqir Hoda keep his word? Will he repay the "honor" he has shown by voting for Klodian Braho, the candidate who now represents the compromised structure of SPAK itself?
If this happens, then we will no longer have special justice, but a "mutual justice", where Vetting dismissals and votes in the KLP are made by bargaining, like goods in the market. And at the head of this bargaining, stands the silence of Altin Dumani, a silence that is worth more than any evidence./ Pamphlet
