The MP of the Vetëvendosje Movement, Armend Muja, has published facts that show the violations of the "Kosovo Clan". The government has blocked the television license and the reactions have been among the most numerous, describing it as an attack on free speech. But in fact below, the deputy shows that he has nothing to do with this issue, but with the company that owns it.
There are two issues related to Klan Kosova - (1) legal requirements for media license OSHMA and (2) legal requirements for business license.
(1) The legislation of the Media Commission adopted between 2008-2010, Article 21, paragraph 3, of the Law on KPM states that 'licenses cannot be used without prior written authorization and approval from KPM' KPM Regulation on Conditions and The Terms of the KPM License, Article 15, point 2, stipulates that 'for any change in ownership that captures more than 10% of the shares of interest or that has a significant impact on the control of the licensee, prior written approval is required from the of KPM
Between 2013-2020, according to KPM, Klan Kosova has never requested approval or announced funding sources and changes in ownership as follows:
1.1 On 20.08.2013 the ownership passes to Florent Nallbani - it has not been announced or approved by KPM
1.2 On 04.12.2015 ownership passes to Nikola Gorgiev, K-Media Corporation, Macedonia - not requested or approved by KPM
1.3 08.12.2015 ownership passes to Seine LTD, British Virgin Island, unknown owners, under management of Cypriot citizen Marinos Stylianides - not notified nor approved by IMC
1.4 On 28.12.2018, Aleksandër Frangaj falsely claims that he is the owner of Klan Kosova and requests renewal of the license. The KPM board composed of Muja Ferati, Violeta Hyseni, Xhemajl Krasniqi, Vlorë Berisha and Anita Muriqi approves the request for licensing, without knowing who the real owner is, as required by the KPM Law and Regulation on License Conditions.
2. Negligence of KPM during the transfer of ownership/KGO Media Investments is not declared if it is legally registered in the Republic of Kosovo, as required by Article 4 of the KPM Law
2.1 On 09.10.2020 Klan Kosova requests a change of ownership from Aleksandër Frangaj to KGO Media Investments, owner Kushtrim Gojani. Aleksandër Frangaj once again falsely presents himself as the owner of Klan Kosova.
2.2 KPM composed of Xhevat Latifi, Granit Musliu, Violeta Hyseni, Azra Dešić and Maja Slavić approves it without any verification.
2.3 Kushtrim Gojani, as the new owner, had not responded to the request of KPM whether KGO Media Investments is a legally registered company in Kosovo and in accordance with the applicable law. KPM contrary to the Law and the requirements of the Regulation on License Conditions, ignores this essential requirement according to the KPM Law and approves the first one, without verification.
2.4 The owners of Klan Kosova between 2015-2020, according to KPM, are unknown. The same have neither been notified nor approved by the KPM, contrary to Articles 21 and 22 of the KPM Law and contrary to the Regulation on the Terms and Conditions of the KPM License.
3. Business and fiscal matters
The Macedonian company "Marketing company KGO Media Investments" ShPKNjP (one-person shpk), which owns the Kosovar company that has a license as television media - "Klan Kosova" shpk, is registered in Skopje, North Macedonia, on April 1, 2016.
3.1 Pronar i vetëm i kësaj kompanie maqedonase është Kushtrim Gojani, nga Gjakova. Në vitin 2016 kjo kompani është regjistruar si kompani me kapital të huaj, nga Serbia. Shtetësia e themeluesit, pronarit të vetëm dhe drejtorit të kësaj kompanie ka qenë Serbia. Adresa: "Hisni Zaimi, Gjakovica, Srbija".Aktiviteti i vetëm i kompanisë, sipas NACE3: 73.11 - Agjencion për Marketing.
3.2 Gjykuar sipas pasqyrave financiare të cilat i ka publikuar në regjistrin tregtar të Maqedonisë Veriore, kjo shoqëri tregtare ka qarkulluar mesatarisht në 2021-2022 rreth 300 EUR në vit (shifrat me denarë maqedonas, shprehur në valutën vendore atje).Më 26.04.2021 kjo kompani e ndërron kontaktin, konkretisht adresën elektronikenga [email protected], në: [email protected]
3.3 Deri në mes të qershorit 2023 situata ka qenë kësisoj. "Klan Kosova" ka operuar në Kosovë, ka qenë e licencuar, për më tepër ka blerë edhe medie tjera në Kosovë dhe ka marrë miratim nga rregullatori.
3.4 Kur mediet raportuan për çështjen ‘Klan Kosova" shpk, në këtë kompani maqedonase janë bërë dy ndryshime të "gabimeve teknike", dhe atë më 16 dhe 20 qershor 2023. Në të dy herët, është ndërruar pasaporta e pronarit. Më 16 qershor 2023, pasaporta serbe është zëvendësuar me pasaportën kosovare. Kurse më 20 qershor 2023, pasaporta kosovare është zëvendësuar me një pasaportë tjetër kosovare. Me këtë rast edhe adresa nga "Hysni Zajmi", është bërë "Faik Konica". Pra, shtetësia e pronarit dhe e drejtorit të kësaj kompanie qenka bërë "Kosovo’
3.5 But how is the work with the origin of foreign capital? We will look at the registration certificate of this Macedonian company and at the declaration certificate of the real owner.
