
Italy's Supreme Court has ruled in favor of a five-star hotel in the Dolomites , confirming that refusing to serve tap water to a customer does not constitute a violation of consumer rights.
The incident dates back to the 2019 ski season, at the restaurant of the Sassongher Hotel in Corvara, where a tourist asked for tap water during her meal. The waiter only offered her bottled mineral water priced at 10 euros, which later led to a legal dispute.
The tourist sought 2,700 euros in damages for emotional distress and economic damage, arguing that “water is a natural resource and a universal human right.” She also claimed that the provision of tap water should have been considered part of the hotel’s basic service, just like “sheets on the bed” or “soap in the bathroom.”
However, the Italian Supreme Court dismissed the lawsuit, stressing that Italian legislation does not oblige restaurants or hotels to serve tap water to customers.
The hotel's lawyer, Silvio Belardi, told the Corriere Alto Adige newspaper that the court's decision clearly confirms that "there is no obligation to provide tap water."
According to Italian media, the case was initially heard in a lower court in Rome, before ending up in the Supreme Court.
