
Lawyer Spartak Ngjela has shown details of what will happen if former Prime Minister Berisha does not appear before SPAK and if the court punishes him criminally.
In an interview for 'Top News', Njela said that if Berisha does not go to SPAK, the authorities have the right to take him by force.
"Berisha does not appear, he is in prison, house arrest is prison, it is the same in the legal concept. If it does not go physically, they have the right to take it by force. Even when he was not arrested, they had the right to take him by force, but they did not take him by force, that's why they put the measure of arrest so that they can take him whenever they want," said Ngjela.
Asked what will happen to the Democratic Party, Ngjela said that the two separate parties should unite into one, leaving out Berisha. He emphasized that if Berisha is convicted, Basha has the right to re-create the PD, re-unite and elect a new leader. If it works like this, according to him, SP will not stay in power for more than 5 months.
"With the elimination of Saliu, it has entered history with a positive or negative sign. I say positive, but time will tell. Now that Berisha will be sentenced, we will see how Basha's story will turn out. I do not wish Berisha a criminal sentence, but he loses his right if he receives a criminal sentence. One cannot think of a man heading for criminal charges. Berisha has a big defect that is non grata in America, if he is to be punished then how does Basha have the right to recreate PD. Here we will see Basha's value as a unifying force, whether the others will accept it or not. To be accepted you need certain criteria, program, audience. When the merger takes place, we will see who will be the new leader of the DP. If the matter goes this way, the socialist party will not go in the direction for more than 5 months" , he said.
When asked who should be represented in the Electoral Reform Commission, the official DP or the parliamentary opposition, according to Njjela, legally it belongs to the legal DP. Njjela said that the only solution is for the two 'wings' of the DP to unite and choose a single representation, which according to him should be from the wing of the opposition action.
"Legally, it belongs to the legal DP. Politically and morally, and in terms of justice, it is up to both wings of the opposition to choose one. These (SP) will do it with the official that they will stick to the formal nature of the law. Now we come to formalism, the official opposition, they act as if they do not understand that there should be a party, a party that the court would recognize. Saliu does not accept to create a party, he insists beyond logical sense. The crisis that Berisha went through, divided the party. For the opposition to be united, the fact that Berisha is under arrest and is not present, it is up to them to unite and bring out their co-chairman. If it were me, I would take it from the wing of the opposition action that this is how softening begins for the two wings of the Democratic Party. Imagine now we are a one-party society, it cannot be divided. The other one (Rama) will settle with Meta. The point is, they have a case, they don't have the president who is non grata, will they join? I do not know. I am dealing with them pragmatically. Without the opposition, it would be lame, we will walk with a prosthesis, one regular leg, the other with a prosthesis that damages democracy. The electoral law is important, there are many points that need to be changed urgently. There is no logic for such commissions to be party members" , said Ngjela.
