The Supreme Court yesterday ordered SPAK to proceed with the criminal complaint of the family of Aleks Nika for the murder that happened 13 years ago, specifically on January 21, 2011 in front of the Prime Minister.
But how does the journalist Fatos Mahmutaj see it, who was injured in that protest on the "Dëshmorët e Kombit" boulevard where 4 protesters were killed?
In an interview for the show "Today Live in Albania" for Report TV, Mahmutaj does not hide his skepticism.
"I am skeptical since SPAK did not act as it should have done in some other files as well. The case of abuse of the 'Partizani' complex where Prime Minister Berisha is under house arrest while he should have been in prison as corruption is rampant. We have members of the municipal councils for 5-10 thousand euros who are sent to prison or for very small tenders, while Sali Berisha who has intervened not only personally but also familyally and Sali Berisha's son-in-law with a small % managed to be owner of the Partizani complex. We have a criminal offense that has been completely consumed while Berisha is under house arrest. Given that SPAK has failed to provide direction for such files, what can we expect for January 21?!"
Mamutaj goes further by saying that responsible for this 'state crime', as the Strasbourg Court calls it, is not only Berisha, Lulzim Basha and Ndrea Prendi, whom the family of Aleks Nika won the battle in the Supreme Court to report to SPAK.
"The person responsible is not only Sali Berisha, Lulzim Basha and Ndrea Prendi, but also other people who shot the protesters, Berisha's security chief who was never charged. As if based on the investigation conducted by the Prosecutor's Office of Tirana, these people should have been convicted for the murder of 4 protesters", said Mahmutaj.
Why this skepticism?
Fatos Mahmutaj has an explanation: "SPAK has all the possibilities to do it, but he remained skeptical that he does not have the authority to initiate a criminal case and take Sali Berisha to criminal responsibility when it is well known that the majority of the Albanian judiciary are appointed by the legal office of Sali Berisha's daughter, let's not think that SPAK will make any big mistakes. Legally, it is up to SPAK to take the issue, but I don't have much faith that it will solve it. We will have delays, we will have delays. 13 years have passed and another 13 years will pass and we will again be talking like today"
Is there any additional evidence that SPAK can receive?
The protesters who were beaten by the police were not questioned as witnesses. We have friends and comrades of the victims and the murdered who have volunteered in the media, giving testimonies and statements. These have never been asked.
The person responsible for January 21 was Sali Berisha, the cause was Ilir Meta. I don't understand why Lulzim Basha is taken. Basha had the courage not to execute Berisha's order. Lulzim Basha had the role of an unfortunate, that of being the Minister of the Interior.
