
On the website of the Special Parliamentary Commission for Good Governance and Anticorruption, the responses of the new justice bodies invited to bring their experts to this commission have been published.
From the published documents, two different positions of representation in this commission can be observed between the Special Prosecutor's Office and BKH.
Since the creation of these two new bodies of justice, various divergences have appeared on matters of the nature of competences.
The same thing seems to have happened with the representation in this commission, which received a positive response for participation in the Xhafaj commission from the head of BKH Aida Hajnaj.
"The National Bureau of Investigation will be represented by Aida Veizaj, Director of the National Bureau of Investigation and Alban Kalaja, Investigator and Head of the anti-corruption sector at BKH. While in the capacity of members of the technical secretariat with Eduard Merkaj Advisor to the Director of BKH and Sadleva Bodo Advisor to the Director of BKH", it is stated in the response to this commission dated 20.08.2024.
But the head of the Special Prosecutor's Office, Altin Dumani, on 03.09.2024, in the response to this special commission, says:
"In consideration of your letter, at the Meeting of Special Prosecutors dated 03.09.2024, this request was also discussed, where the special prosecutors expressed appreciation for any initiative of the Assembly to cooperate with justice institutions for improving the rule of law and the fight against corruption and organized crime, respecting the principle of separation and balance of power.
The Special Prosecutors also expressed their conviction that an institutional cooperation that respects constitutional balances and meets international standards is the foundation for achieving our common objectives in strengthening the rule of law and accelerating the integration process of our country in the European Union.
In this meeting, it was unanimously agreed that our institution, through the annual report, has made public the problems encountered on its operation and the effectiveness of the investigation, including the need for relevant legal changes.
For the above, the Special Prosecutor's Office expresses its willingness to contribute to joint efforts to improve the rule of law and the fight against corruption and organized crime, providing continuous support through the provision of legal opinions whenever deemed necessary by your side".
The Law on the Organization and Functioning of Institutions to Fight Corruption and Organized Crime Article 5 states:
"The National Bureau of Investigation is the specialized structure of the judicial police that investigates criminal offenses under the criminal jurisdiction of the special prosecutor's office according to the provisions of the criminal procedure code.
While Article 31 provides that "The National Bureau is a specialized structure of the judicial police that acts only in the direction of the special prosecution".
So BKH acts and interacts under the direction of the head of the Special Prosecutor's Office. / Top Channel
