This Monday, March 9, the Special Court of Appeals is holding a hearing on the security measure "suspension from the exercise of office" for former Deputy Prime Minister Belinda Balluku, following the reasoning of the decision by the Constitutional Court.
The appeal of the Court of Appeals has overturned Belinda Balluku, leaving the measure of suspension from office in force.
The decision was made by Judge Miliana Muça, who reviewed the appeal filed by Balluk's lawyers against the security measure.
Balluku is no longer Minister of Infrastructure and Energy and Deputy Prime Minister, and the Special Appeal must make a decision, even if it means finding that there is no merit to this matter.
The Constitutional Court ruled on February 6, regarding the request submitted by the government regarding the decision of the Special Court Against Corruption and Organized Crime (SCOC), which in November 2025 decided to suspend Belinda Balluku from her duties as Deputy Prime Minister and Minister of Infrastructure and Energy.
The Constitutional Court decided to dismiss the government's lawsuit, after the judges voted 4 in favor and 4 against, failing to reach the necessary quorum. Thus, the suspension measure for Belinda Balluku, which had been lifted on December 12, 2025, was reinstated by this court's verdict.
“The court emphasizes that according to the Constitution, the system of government is based on the principle of the rule of law, according to which even ministers are subject to the law and can be held legally responsible if they violate it. Among other fundamental principles are those of the supremacy of the Constitution, the supreme law and the direct application of its provisions, the obligation of the state to act within the basis and limits of the law, and the separation and balance between the legislative, executive and judicial powers.
Regarding the subject matter of the request, at the end of the discussions, the judges' assessments were divided into two positions and the Court did not reach the required number of votes for decision-making. According to one position, the Court stated that the immunity of deputies is not their personal privilege, but its main purpose is to protect the Assembly itself and in particular its proper functioning. In this sense, obtaining authorization from the Assembly for the implementation of measures that limit the freedom of the deputy in advance aims to protect the activity of the Assembly itself," the official announcement states, after 11 hours of consideration by the black platoons.
Meanwhile, a meeting of the Socialist Party group is taking place at the Presidency of the Assembly, where the Socialists' decision on SPAK's request for the arrest of former Deputy Prime Minister Belinda Balluku is expected to be announced. Socialist leader Edi Rama will speak at the meeting.
The drafting of the report of the 5 SP members in the Mandates Council has been entrusted to the chairman of the Laws Committee, Ulsi Manja. Taulant Balla has ordered that all deputies be present, while Balluku will not be absent either.
