
The implication of the former Minister of Health Ilir Beqaj, in the concession of 100 million dollars for the sterilization of surgical equipment, has brought a legal clash between the two prosecutors of the case and the head of SPAK, Altin Dumani.
The clash came as a result of the mild and sparing stance, regarding the investigative actions of the two prosecutors Kondili and Nakuçi, in determining the criminal responsibility of Ilir Beqaj in this file.
Based on this situation, before the two prosecutors turned to the GJKKO with a request to set security measures against businessman Ilir Rrapaj, former deputy minister Klodian Rjepaj and 6 members of the Concession Granting Commission, "Ora News" has learned that the head of SPAK, Altin Dumani expressed his opinion in writing against what the two prosecutors had presented in the file.
Dumani, has requested and expressed an opinion on the exercise of criminal prosecution and the taking of concrete legal steps for the criminal position of the former minister Beqaj.
Duman's legal arguments, suggesting the investigation and the issuing of legal responsibility for Beqaj, are administered in the file.
"...with as much space as the law allows me, I, as the head of the institution, have given my legal opinion on the orientation of the investigations for bringing Ilir Beqaj to criminal responsibility...", Dumani declared during a meeting with journalists.
In the same line as Altin Dumani, the judge of GJKKO, Erion Bani, has come out. During the evaluation of the request for the assignment of security measures against 8 persons, judge Bani has argued in the decision over 300 pages, that the two prosecutors Ervin Kondili and Ened Nakuçi should extend the investigations and assign criminal responsibility to the former Minister of Health Ilir Beqaj.
Bani argues that from the opening procedure until the closing of the practice for announcing the winner of the sterilization concession, the active participation of former minister Beqaj is clearly visible.
In addition, the judge argues in his decision that the SPAK special prosecutor's office should extend the investigations to the verification of Ilir Beqaj's wealth or corrupt actions.
For 3 years, the two SPAK magistrates, Ervin Kondili and Ened Nakuçi, have been investigating the case of corruption and fraud with serious consequences, which is related to the financing from the state budget of the 10-year sterilization concession.
In June 2023, Judge Bani ordered the arrest of the owner of the concession company "Sani Service", Ilir Rrapaj, and the former Deputy Minister of Health Klodian Rjepaj.
While imposing mild measures such as house arrest and obligation to appear for other persons Arben Gjata, Pertef Mersini, Genc Burazeri, Naile Ajazi, Saimir Kadiu economic director, and Marsela Serjanaj legal director in the ministry. /Time News
