The denunciation addressed on the "Stop" show this Tuesday, May 19, is related to an issue in Ksamil, where suspicions have been raised that the Memko family, which includes Saranda prosecutor Hava Memko, has illegally acquired 21 hectares of forest and pasture land near the coast.
" This is one of the hottest issues in Albania, not in the south of Albania because the Ksamil pasture, the Ksamil forest is a very large area and coveted by locals and foreigners. Those 21 hectares returned, today are being asked for 80 million euros on the market. I received from the state archive with a blue seal, the main document from the time of King Zog 1926, where all the owners are listed one by one... the Memko family is not included, it is not in this co-ownership.... We have continuity from 1926-1945, where this family is not part ."
According to the complainant, the property was acquired through a 2001 decision of the Property Restitution and Compensation Agency, Vlora regional branch.
This decision is subject to suspicions of forgery of inheritance documents, the institutional seal, and the signatures of the commission members.
An expert report conducted by independent expert Vladimir Konomi found that the signatures of the commission members were forged by the same person, raising serious doubts about the legal validity of the decision.
Meanwhile, according to the asset declaration forms, it turns out that prosecutor Hava Memko has not declared this property, although the law requires her to do so.
Former prosecutors Ervin Karanxha and Gentjan Ternova explain that the failure to declare assets constitutes a legal violation. The Council of Ministers has also reacted to this issue, opening a legal process in the Court of Saranda, seeking the absolute invalidity of the 2001 decision, through which the 21 hectares in Ksamil were acquired.
"Stop"'s conversation with lawyer Taulant Erindi:
Journalist: How are you? Taulant? Genci Angjellari from TV Klan, the show "Stop"! I wanted to ask you, regarding a case, that you are representing the state in a process, regarding the Memko family and a number of other families, who have benefited from a property in Ksamil and the Council of Ministers has sued this. Are you the lawyer, who is following this trial in Saranda?
Taulant Erindi, State Attorney's Office: Yes, it's true.
Journalist : Can you tell us some details, what stage the process is at? I'm interested in the Memko family...
Taulant Erindi, State Attorney's Office: In fact, the State Attorney's Office represents such a process against the heirs of Memko, Agim Memko, where it requests the annulment of a decision of the commission, which we assess, was taken in violation of the law. We are currently in a court session, awaiting the expert report, which will determine whether the state will be legitimized to file this lawsuit or not.
Journalist: Why does the state have doubts regarding this 2001 Property Restitution and Compensation Decision, am I wrong?
Taulant Erindi, State Attorney's Office: It's from 2001 and there's a later one. There are two commission decisions...
Journalist: About falsehood, or what are these decisions about, if you can give us details?
Taulant Erindi, State Attorney's Office: For absolute nullity is the object and the ownership obligation of the Albanian State, according to the archival documentation available to the State Attorney's Office, we assess that the Memko heirs are not owners in the Ksamil area...
Journalist: It's 21 hectares, so a lot of property?
Taulant Erindi, State Attorney's Office: Yes, it is about 21 hectares...
