The legal vacuum regarding narcotic and psychotropic substances is being exploited by traffickers and distributors for profitable activity.
Megaoperation 'Temple', which was finalized with the arrest of 233 people across the country, also seized several types of previously unknown substances. Despite not being included in the list of drugs, other substances that circulate in Albania, such as the case of balloons, mainly in nightclubs for young people, are classified as psychotropic substances and are equally punished by the criminal code.

"Specifically, Article 283/ai of the criminal code entitled drug trafficking, provides that the import, export, transit and trade, contrary to the law, of narcotic or psychotropic substances, is punished with imprisonment from seven to fifteen years. And this crime, when committed in collaboration or more than once, is punishable by imprisonment from ten to twenty years. The organization, management or financing of this activity is punishable by imprisonment of no less than fifteen years," said lawyer Ervis Gorishti for Report tv.
Jurists say that in the new penal code, experts should take these innovations into account, while the possibility that the type of punishment may vary based on the damage caused by drugs or psychotic substances should be considered.
"The balloon drug is known as a gas that changes the user's state within minutes, mainly causing laughter, euphoria, altered senses, disorientation and reduced anxiety. But for some people, such substances can cause dizziness, nausea, headache, loss of consciousness, asphyxiation, drop in blood pressure, arrhythmia and death from cardiac arrest. According to a medical publication, based on the theses of the German pharmacologist Louis Lein, narcotics include those without nitrogen: which include substances that, in large doses, can cause hallucinations, euphoria and pleasure, such as cannabis and the group of nitrogenous narcotics: which includes the real hallucinogenic substances, such as: Lysergic acid diethylamide, Phenylcyclidine, Mescaline and Psilocybin. Albanian customs have in the legal basis of their work,he said.
