
As he awaits the start of the trial on the merits in the Special Court, this Monday Alfred Beleri will once again face the Appeal, to request release from the cell.
At first, the request of the elected mayor of Himara to be released from custody was rejected once by the Court of Vlora, twice by the Special Court of First Instance, once by the Court of Appeal and once by the Supreme Court.
In the reasoned decision of the latter, the arguments of the courts for dismissing Beler's claims are clarified.
In all three stages of the trial, the relevant judicial bodies have assessed that there is a reasonable suspicion, based on evidence, that Alfred Beleri has committed the criminal offense of "election corruption".
"The court has reasoned that due to the personality of the person under investigation, Dhionisios Alfred Beleri, given that he has been convicted before, there is a real risk that he will commit more serious or equally serious criminal offenses... due to the criminal offense of which is suspected, the margin of punishment and the stay of the person under investigation, there is a real risk that he will leave, making the normal development of the investigation impossible... due to the position of the person under investigation, there is a risk that he will influence the taking or authenticity of the evidence".
To justify the same position, the Special Appeal highlighted the existence of attempts to obstruct the investigation.
"The court also takes into account the fact referred by the prosecution in the hearing in the appeal trial that in the minutes of the environmental inspection, from the examination of the photos of the premises of the bar where the meetings between Mr. Dhionisios Alfred Beleri and Mr. Arsen Rama and Mr. Pandeli took place Kokaveshi and Mr. Arsen Rama, it is understood that the bar has security cameras and that although this fact has turned out to be such even within the premises of this bar, it has not been possible until now to seize the recording device of the bar's cameras".
In its decision, the Supreme Court emphasized the fact that Alfred Beleri was sentenced to 3 years in prison by the Vlora Court of Appeal in 2006, he never went to jail, as he avoided criminal proceedings until the prison sentence was prescribed.
"He avoided the criminal punishment assigned to him previously by the courts for the criminal offenses for which he was convicted of "calling for national hatred" and "humiliation of the Republic and its symbols", which shows that the person under investigation, Beleri, has a tendency and presents a risk not only of leaving, but also of committing serious crimes, or of the same type, as the one for which the proceedings are being carried out".
Furthermore, considering Alfred Beler as a particularly dangerous person, the Supreme Court estimated that he could intimidate future witnesses, or contribute to the destruction of evidence.
The criminal case against Beler went to trial last Thursday. In every confrontation with the court, since his arrest on May 12, Beleri has denied the accusation, considering it baseless, and has described the investigation against him as influenced by politics./A2CNN
