KPA decided today to review the vetting for former prosecutor Antoneta Sevdari after the latter sent the case of her dismissal to Strasbourg and won it.
After the review, the KPA decided to return to duty.
Sevdar's request for review in the College came after the European Court of Human Rights, ECtHR found a violation of Article 8 of the Convention in the case of her dismissal by the Special Appeals Chamber. The Court noted that the dismissal decision was "disproportionate". .
Why was prosecutor Sevdari fired from Vetingu?
Prosecutor Sevdari passed without problems in the Independent Qualification Commission, but the Public Commissioner stated that the decision of the First Instance was made without first conducting an in-depth investigation in at least two criteria.
Her husband's fortune also brought the final verdict. The Special Appellate Panel declared as insufficient the justification of her wealth and that of her husband, who lived in Saudi Arabia, sources that partly evaded taxes.
In terms of professional skills, the College decided not to initiate investigations into the 10 complaints received against her, because they do not contain sufficient facts and circumstances.
The college decided that Sevdari "has violated the trust of the justice system", thus changing the decision of the KPK a year ago.
In the month of March 2024, as never before since the initiation of the vetting process in justice, the Special Appeals Panel decided to review a decision given by it to exclude a prosecutor from the system.
Although the decisions of the KPA are final and unappealable, in the case of the prosecutor Antoneta Sevdari, the revision of the decision was a task assigned to the Albanian state by the European Court of Human Rights in Strasbourg.
The decision of Strasbourg, which paved the way for the retrial of the "Sevdari" case at the KPA, was announced in December 2022. The European Court said that the dismissal of Sevdari was disproportionate to the problems observed in the property provided by the husband before the marriage.
In the same decision, Strasbourg forced the Albanian state to indemnify Sevdar and compensate court costs in a total of 24,600 euros.
