Dorian Matlija, lawyer for the families of the Gërdec tragedy, has rejected the claims of former minister Fatmir Mediu.
Matlija explained that today's accusation against Fatmir Mediu is "abuse of office" and he is currently on trial, but added that SPAK may also conduct investigations into other aspects.
" There have been many trials, but there was a main trial that was divided into two parts, the trial for 30 defendants, one continues to be tried today. 29 others have been tried and the verdict has been finalized. There are many aspects to the Gerdec affair.
Regarding the loss of life, the court that concluded the trial said that the order 20/44 signed by Mediu was the one that was linked to the cause-effect chain that brought about the tragedy. Four people were convicted in 2013, and then one person, who gave it legal force and made the order valid, is the person on trial, Fatmir Mediu. The charge is abuse of office. The investigation was conducted in 2008-2009 by the Prosecutor's Office at that time.
The initial charge was murder in qualified circumstances, which is what the prosecution went for to request the lifting of Mr. Mediu's immunity. Were they in conditions of negligence, intentionally, unintentionally, indirectly intentionally. The prosecution had the idea that there was evidence that not only was it an accident, but they had the opportunity to predict what would happen. It was a different type of criminal offense at the time. But then it was reduced to abuse of office.
Today SPAK, which took over the case, has been forced to start the discussion where it left off in 2009, on abuse of office. It is not certain that it will not change, but this depends on the court. We are still in the phase where evidence is being collected and the defendant has not finished with his comments on the evidence. This phase has taken a long time, three years. Complicated expertises have been obtained. Other offenses, there may be corruption, laundering of proceeds of crime, and so on.
The new justice system has the task of taking the old file prepared in 2009, and moving forward. As for other elements that may be discovered along the way, they are being investigated.
The accusation against Mediu was not made today, but in 2008-2009 when they were in power. A political trial here makes no sense, as the accusation is based on over 26 thousand pages of documentation, witnesses, and two forged expert reports.
"It cannot be a political trial, when the accusation is that the armed forces have knowingly evaded strict supervision, you have given the green light for demolition near a village and near a highway. There has been a constant disregard for several danger signals ," said Matlija, among other things, when invited to the show "The Unexposed" on MCN TV.
