The High Court has overturned the decision of the Special Court of Appeals for the former director of RTSH, Thoma Gëllçi, previously convicted of "abuse of office", deciding to return the case for retrial by another panel.

According to the decision, the process must start over at the Special Appeal, essentially reopening the case against Gëllç. This development is considered an important step for his legal defense, as he had sought acquittal in the Supreme Court.

Gëlçi was initially sentenced to 2 years in prison, a sentence that was reduced to 1 year and 4 months of imprisonment due to a summary trial. He has completed his sentence and is currently free.

The case is related to a tender procedure for equipment for the RTSH Agro channel, where, according to the accusation, a contract addition was made outside the legal deadlines.

His lawyer, Dorian Matlija, described the Supreme Court's decision as an indication that the previous process was flawed from the start. According to him, the retrial creates the opportunity for the restoration of fair standards and a full reassessment of the evidence.

He also emphasized that Gëlçi had previously won a case at the European Court of Human Rights in Strasbourg, regarding his arrest.

" Today's decision by the Supreme Court to overturn the conviction of Thoma Gëllçi is a clear signal that the standards of handling this case to date were problematic from the start. This is a reinforcement of the previous development when Thoma Gëllçi won in the Strasbourg Court against his arrest."

This case has long raised serious concerns about the way criminal prosecution was used, creating a practice that imposes criminal liability without criteria.

Now, with the return of the case, a real opportunity opens up to restore fair standards and repair the deviations that have characterized this process since its inception.

"Today's Supreme Court decision strips the case of previous conclusions and returns it to the point where it should always have been, where the burden falls on SPAK to show us why an innocent citizen did not deserve this innocence from day one ," he writes.
