The Tirana Court has imposed the security measure of "prison arrest" on Bardhyl Fusha, who a few days ago attempted to rob a second-tier bank in the capital with a Kalashnikov.
During the court hearing, defense attorney Mirash Ndoci requested an assessment of his client's psychological and mental state at the time of the incident. According to him, the circumstances in which Fusha acted should also be analyzed from this perspective.
The defense also requested a lighter security measure than "prison arrest", arguing that the defendant immediately surrendered to the Police and did not cause any consequences to human lives. The lawyer emphasized that, according to him, this was not a well-organized robbery and that Fusha acted under severe financial pressure.
The lawyer, Mirash Ndoci, said:
In my capacity as the legal defender of citizen Bardhyl Fusha, I feel obliged to clarify public opinion regarding the circumstances of the event and the defense's position.
From the dynamics of the facts made public, it results that:
Mr. Fusha appeared at the bank premises in the middle of the day;
He was unmasked;
He left his personal vehicle parked in front of the bank;
After leaving the bank, he immediately surrendered to police officers;
He did not resist and did not attempt to escape;
There were no physical consequences or loss of life.
These elements, in the opinion of the defense, do not fit the typology of an organized or well-structured robbery, but show a lack of professional planning, a lack of escape strategy, and a lack of escalation of violence.
The suspect Bardhyl Fusha has stated that he acted under severe financial pressure, due to unpaid obligations to his employees in a considerable amount. The commercial entity he managed resulted in serious economic difficulties and tax obligations, which further aggravated his personal and psychological situation.
The defense believes that we are dealing with an isolated act, committed in a moment of strong emotional shock, and not with a stable criminal tendency.
For this reason, within the framework of the judicial process, the defense requested:
Assigning a more lenient security measure than "prison arrest", given that there is no risk of escape or recurrence;
Conducting a psychological/psychiatric examination to assess his mental state at the time of the incident.
We fully respect the judiciary and expect the matter to be handled objectively, proportionally and in accordance with the standards of due process.
The incident occurred on February 12. Bardhyl Fusha, known as an entrepreneur in the construction field, stated after his arrest that he had financial obligations to his employees and that this situation prompted him to take action.
According to official data, he managed to take around 8 million old lek from the bank's cash register, but was arrested immediately after leaving the financial institution's premises.
