Seized after clash with prosecutor, Prosecution returns cellphone to lawyer

The Tirana Prosecution Office has returned the seized phone to lawyer Ulian Barjami, who was released from his cell two days ago after being detained by Judicial Police Officers following allegations that he threatened prosecutor Gjergji Ceka during a session at the Elbasan Court.

The decision to return the phone was made by the prosecutor in the case, Esmeralda Keshi. The case was initially at the Elbasan Prosecutor's Office, but yesterday it was declared incompetent due to a conflict of interest, as the prosecutor involved in the case, Gjergji Ceka, exercises his duties at this institution.

Also regarding this issue, the High Inspectorate of Justice has initiated verifications on its own initiative regarding the detention of lawyer Ulian Barjami. The latter was released by order of the Elbasan Prosecutor's Office, where after the materials arrived for evaluation, the prosecution concluded that there were no conditions and needs for the continuation of this detention, or the imposition of a security measure, and consequently ordered his immediate release.

"I will deal with you personally," is the statement that Ulian Barjami made in the session on October 13, addressed to prosecutor Gjergji Ceka. We recall that Ulian Barjami was handcuffed after prosecutor Gjergji Ceka's report. Lawyer Bajrami accused the prosecutor of evidence manipulation, while addressing him, saying that he will personally deal with him and the Judicial Police officers.

He even added that he would file a report after finding elements of a criminal offense. This statement was taken as a threat by the prosecutor, who filed a police report. The lawyer was accused of “Threat due to duty”, “Threat of a judge” and “Opposition and striking a judge”.

Lawyer Ulian Barjami was released two days after being placed in handcuffs by order of the Elbasan Prosecutor's Office. Barjami's arrest led lawyers across the country to decide to boycott all hearings until October 25, except for hearings on security measures. However, with Barjami's release, it remains to be seen whether the Chamber of Advocates will withdraw from the boycott or continue it for up to 5 days. The Chamber of Advocates also requested urgent consideration of the case by the ILD, KLGJ AND KLP.
