Special Judge Irena Gjoka has stated at the Special Prosecution Office that she did not violate the law when she did not declare a 2005 criminal decision by a court in Ioannina.
Her testimony comes after the Democratic Party was accused of forging forms and stamps.
In the minutes given before SPAK, Gjoka denies knowledge of any criminal proceedings against her in Greece and of the existence of a court decision.
"I have never been aware of the criminal investigation process conducted against me, nor of the judicial process, nor of any other process conducted by the Greek justice authorities," Gjoka declared.
It links the refusal of entry to Greece in 2002 and 2003 to an incident at the border, not to any criminal proceedings.
"In December 2002, I reported to the Kakavija border checkpoint to travel to Greece and after an argument with the border police officers, due to their arbitrary behavior, I was refused entry to Greece, with the visa I had obtained at the Greek embassy in Tirana being cancelled," the testimony states.
Gjoka adds that since 2007 she has entered Greek territory normally and has not been notified of any criminal decision, investigation or administrative measure by the Greek authorities. According to her, Greek law itself considers the case archived and without a final decision.
The testimony was made public by the leader of the Democratic Party, Sali Berisha, during his appearance at SPAK for the measure of compulsory appearance in the “Partizani” file. Gjoka was the judge of the preliminary investigation in this case.
Berisha claims irregularities in the testimony record, stating that the document was sent to the court without the investigators' signatures.
"This is the investigation that Altin Troplini conducted for Irena Duman. Now, that a record, a testimony, the one who has been summoned will answer the questions, without question. But that the investigators, Toni Gramo and Elton Kërluku, have not signed. It is for Guinness, friends.
"A court file sent to the court. Why didn't they sign it? They didn't want to sign Irena's fraud with 5 surnames," said Berisha.
The case is in court. SPAK has requested the termination of the criminal proceedings with the argument that the process in Greece was conducted in Gjoka's absence and without his knowledge. The prosecution adds that even if the criminal decision is accepted, the criminal prosecution has been terminated due to the statute of limitations.
