
The President of the High Judicial Council, Naureda Llagami, presented at the beginning of the plenary meeting on Wednesday, October 11, the concern regarding the appointment and assignment of 40 new magistrates, a process that has been held hostage for two and a half months by the council that she leads in violation of the law.
She described Wednesday's meeting as a priority for the transfer of six judges to Tirana, Durrës and Elbasan, stressing that this was because the appointment of magistrates was a priority. Llagami noted that these transfers of judges in office are the measures the council is taking to enable the appointment of new magistrates within the next week. The HCJ also announced that the appointment of 40 magistrates will take place on Thursday.
The HCJ, previously asked by BIRN regarding the delay in the process of appointing and appointing 40 new magistrates who graduated in June, justified that the process of parallel movements and promotion of existing judges was still being carried out. The non-appointment for two and a half months of 40 graduates as judges is contrary to the law "On the status of judges and prosecutors..." which stipulates that within a period of one month from the date of publication of the list of graduates, the councils appoint magistrates any person who is on the list of graduates, who fulfills the nomination criteria.
While the Supreme Court of Justice has delayed the appointment of 40 new magistrates, requested by it itself in 2020, contrary to the law, the courts have been emptied by the vetting process and around 100 thousand files remain in stock to be reviewed.
At Wednesday's meeting, the Council made a decision on the transfer of Judge Thomaida Roça to the Court of Elbasan through the procedure of parallel movement. With a parallel movement, the transfer of judge Nertila Kape to Tirana was decided. Also, the temporary transfer of judge Suela Xhani to the Court of Durrës was decided; judge Ardit Kuka was transferred to Elbasan; while judges Ramiz Lala and Arben Dosti were transferred to Tirana./ BIRN
