When 3 months have passed since the suspension of IPARD II funds by the European Commission, following suspicions of corruption, AZHBR, the authority responsible for the distribution of the money, has been put in motion. So far, 82 beneficiaries have been identified in violation of IPARD funds, where 17 are listed as debtors after refusing to return the money, in the total amount of 410 thousand euros (current exchange rate). It is not yet known whether this amount matches the findings of OLAF, the European authority that conducted the investigation into the abuse of IPARD II funds. What is known is that SPAK is conducting preliminary investigations but has not yet communicated the names of the officials involved.
The suspension since July of millions of euros in grants for agriculture, which the European Union gave to Albania under the IPARD program, due to suspicions of corruption, has set the Albanian authorities in motion.
The Agency for Agricultural and Rural Development has requested the return of money to 82 beneficiaries of the IPARD II program resulting from a violation of the terms of the contract.
The data provided by Faktoje through a right to information request show that out of the total number of subjects found to be in violation, 17 of them refuse to return the amounts received, with a total value of 410 thousand euros.
"Specifically, the entities appearing in the IPARD debtors register are: Fiqiri Sinani PF; Aldo Jakupi PF; Coast to Coast LLC; LORAG LLC; Mirjan Allka PF; Abbas Pere PF; Vasillaq Xhufka PF; Brisilda Blido PF; Mirjana Godeni PF; Naim Karaj PF; Ilirjan Muhametaj PF; Perla&Aura LLC; Blerti Mehillaj PF; Erind Hajdari PF; Oltjan Nika PF; Anna X Group LLC; Mazllem Celiku PF.", informs AZHBR about Faktoje, emphasizing that "the subjects have been requested to return the sums (total/or partial/advance payment)."

Most of the beneficiaries, already indebted to AZHBR, result in investments in the fruit and vegetable sector, and the rural and nature tourism sector. Contacted by Faktoje, one of the beneficiaries of IPARD II funds who has refused to return the money requested by the Agency for Agricultural and Rural Development, also refused to give explanations regarding the reasons for this decision.
What happens to the 'debts'?
In the register of debtors of IPARD II in Albania, there are currently 17 entities that refuse to return the money received in the form of grants dedicated to agriculture. Referring to the official data of the AZHBR, in a few months, the list of debtors has been increased by 7 subjects.

Ilir Pilku, një nga tre ekspertët e certifikuar nga BE-ja në Shqipëri, për “Politikat e Përbashkëta Evropiane” sqaron se pas refuzimit, autoritetet e adresojnë problematikën në gjyqësor.
“Në bazë të një marrëveshjeje që Ministria e Bujqësisë ka me DG Agrin detyrimin ndaj shlyerjes së fondeve e ka si detyre qeveria shqiptare. Qeveria shqiptare është e detyruar të rimbursojë Bashkimin Europian për vlerën e dakordësuar nga mbrojtja, që në këtë rast është struktura operative e IPARD-it në Shqipëri dhe Zyrës së OLAF-it në Bruksel. Dhe më pas, qeveria ndjek rrugët ligjore për pjesën e pakthyer nga subjektet, hap procese gjyqësore ndaj subjekteve të gjetura në shkelje të kontratës.”, sqaron Pilku, teksa thekson se kjo lëvizje i hap rrugën çeljes së fondeve të tjera për bujqësinë, në rastin tonë programit IPARD III.
OLAF ‘kopsit’ raportin
Zyra Europiane Kundër Mashtrimit, e njohur si OLAF konfirmoi për Faktoje se ka mbyllur një hetim në lidhje me dyshimet për shpërdorimin e fondeve të financimit nga programi IPARD II i Bashkimit Evropian në Shqipëri.
“Si rezultat i përfundimit të hetimit, OLAF ia ka përcjellë raportin përfundimtar dhe rekomandimet e saj autoriteteve kompetente përkatëse.”, shkruan zyra e shtypit pranë OLAF teksa shton arsyet përse nuk mund të komentojë më tej në këtë fazë:
“Për të respektuar konfidencialitetin e hetimit, të çdo procedimi të mundshëm pasues, të të drejtave procedurale dhe të dhënave personale, OLAF nuk është në një pozicion për të komentuar më tej në këtë fazë.”
Dosja IPARD ‘rikthehet‘ në duart e SPAK
Pasi shpalli moskompetencën në vitin 2022, Prokuroria e Posaçme kundër Korrupsionit dhe Krimit të Organizuar në shtator 2023 i konfirmoi Faktojes se ka hapur hetim penal mbi shpërndarjen e fondeve të bujqësisë nga programi IPARD II në Shqipëri.
Të dhënat e siguruara nga Faktoje përmes një kërkese për të drejtë informimi tregojnë se procedimi i SPAK është në fazën e hetimeve paraprake.
“Në lidhje me kërkesën për informacion të bërë nga ana juaj, që bën fjalë për hetimin mbi shpërndarjen e fondeve të programit IPARD, ju bëjmë me dije se procedimi penal në fjalë është në fazën e hetimeve paraprake. Bazuar në nenin 279/1 të Kodit të Procedurës Penale, aktet hetimore dhe përmbajtja e tyre përbëjnë sekret hetimor. Si rrjedhim, nuk mundemi t’ju japim informacione të mëtejshme në lidhje me sa kërkohet nga ana juaj.”, shkruan SPAK.
The IPARD agricultural support program offers grants in aid of the agricultural sector to all countries that are in the process of joining the European Union. Albania is one of the five beneficiary countries of grant support. Through the IPARD II program, which was implemented between 2014 and 2020, Albania benefited from over 71 million euros in funds. And while the country was waiting to start supporting agriculture through IPARD III with 146 million euros in grants, the European Commission decided to temporarily suspend them, based on suspicions of corruption. / Prove it
