The large vacancy in the justice system has created a volume of files for prosecutors in the country. The concern was also raised before the KLP by the General Prosecutor, Olsian Çela, where he indicated that the system has 198 prosecutors available, while 123 are missing.
In "Confrontation" on Report TV, journalist Keti Banushi says that every day there are departures from the ranks of prosecutors.
This year, the difference from last year was the judicial map, which he considered a success. There are 123 prosecutors missing in the system. This has come as a result of vetting. Almost every day prosecutors leave. It is a process that should be completed in the first instance by December.
Every day there are more departures from the ranks of prosecutors than there are appointments. There are 10 prosecutors in the Appeal, out of the 16 that should have been. Even the Prosecutor's Office of Tirana suffers. Not to mention the infrastructure aspect. The large number of files shows that the level of investigation is not where it should be," said Banushi.
The Chairperson of the Helsinki Committee, Erida Skëndaj, said via Skype that the infrastructure in which the prosecutors work, in addition to the volume of files, is a major problem.
"The decrease in the number of prosecutors is causing concern. There are investigative deadlines that are not fulfilled in a reasonable time. There is a delay in investigative evidence also as a result of the low number of prosecutors. When talking about the efficiency of the justice system, there must also be facilities appropriate. When we went to the Fier Prosecutor's Office, we saw a large volume of files. Before drawing up the judicial map, we often found our conclusions" .
Lawyer Arbër Hoxha also sees problems in the District Prosecutor's Offices, as they carry the biggest burden.
"There is an increased problem in the District Judicial Prosecutions. Of the 321 prosecutors that should be, missing 128 is almost half, it is too much. Less quality investigations mean less quality justice. The prosecution is the one that conducts investigations. 40% of these prosecutors are missing, it is very worrying.
The code of criminal procedure was modernized, however the mindset remained the same. The agreement with the prosecutor is established in the code. There are some problems that are created by the vacation. There are also vacancies in the judiciary. It is shameful how a case goes to Durrës on December 15 and so far no session has been held', underlines Skëndaj.
The security expert, Fatjon Softa, adds that the lack of justice due to these problems increases the cases of suicide among citizens who do not find justice.
'We have a decrease in the efficiency of the work of the prosecution. It is a situation that comes and becomes more difficult, since the citizens also have difficulties. Some people do not find justice, and then go to self-judge.
There is a crime every day, even one that is not at the level of assassination. This then leads them to self-judgment. As a whole there are fluctuations, warm up and down. As long as Duman mentioned several cities, mainly coastal areas, where cooperation between crime and justice is evident. They are tolerated for big things', says Softa.
Hoxha adds that the amount of money illegally coming to the country has already increased, making the real estate sector more expensive, such as in Paris or Barcelona.
'The money coming from the EU illegally has increased tenfold. They enter Albania and the real estate market has grown tremendously. It is shameful that Tirana is more expensive than Paris, Barcelona. Today you arrested the former director of ARRSH, he committed childish actions. Thick actions', adds the lawyer.
