"The Constitution 'should not be misleading' about the salary

Zaçaj says they don't feel under pressure, that they are used to such statements coming from all sides...

The President of the Constitutional Court, Holta Zaçaj, reacted today to Prime Minister Edi Rama's statements regarding the request of the Union of Judges seeking a 700 euro salary increase, the second in three years, where she expressed that she "hoped not to make the same mistake again" by approving it, because it was an interference in the powers of the executive.

In a statement to the media, Zaçaj said that she stands by the statement given the day before regarding political statements on increasing judges' salaries. The President of the Court of Justice says that they do not feel under pressure, that they are used to such statements coming from all sides and that the media gives more attention than necessary to some topics or voices about their decisions.

"We stand by what we said in the press release. We appreciate that any of our decisions may be subject to criticism. And I have emphasized the fact that the right to freedom of expression means exactly this. But the limit remains to criticism, not pressure," said the president of the GJK.

As for the non-implementation of some Constitutional Court decisions by the government, she underlined that their decisions are independent and impartial, which must be implemented, but politics takes its toll on everything.

"I do not believe that we are at this point of non-implementation. When we had the opportunity, we have said it, of course I have expressed that the implementation of the decisions of the Constitutional Court shows the stage of democracy. Of course, we still have work to do, but in its own authority, our decisions are enforceable. There are certain decisions that politics takes its own cost if it does not implement them, when we talk about other powers. The important thing is that the Court functions, we came out with an announcement because our duty is to guarantee the public that the Court functions independently, impartially, of course, we appreciate the opinions that come from all sides, including the media, but essentially it is important that the public is informed, receives the right information and for our part to assure the public that we are independent and impartial, to do our job, regardless of who the interests and parties involved in the process are", added Zaçaj.

Asked about Prime Minister Edi Rama's statement, if it was seen as a form of pressure, Zaçaj explained that such statements are often made by the parties in the process and they were used to them. According to her, it was important that the Constitutional Court's decisions were independent and impartial, while she also advised the media not to give more voice than necessary to some issues.

"These are common statements that we have seen from all parties involved in the process, including the media, I want to emphasize and consider. Because sometimes it is you in the media who give more voice than necessary to the thoughts, opinions that are given about our decisions. However, as long as it comes within the framework of freedom of the media and expression, this is an added value, since I am a partisan myself, but also a troop. So what we considered important, the obligation to the public, to inform and guarantee our independent and impartial function, we fulfilled. The rest remains for the way each of the powers thinks to act and sees its duty, but for us this is the most important part", stated the President of the Constitutional Court.
