The Mayor of Tirana claims that there was no collegial decision-making on his request to the prosecutor

Erion Veliaj, mayor of Tirana, has addressed an official request to the members of the High Prosecutorial Council, objecting to the way his request for the invalidity of the decree appointing prosecutor Ols Dado was handled.

According to the document, Veliaj claims that the issue was not reviewed by the KLP as a collegial body, but was handled only by the institution's vice president, Erind Gërmenji.

The request states that during the process at the Administrative Court of First Instance in Tirana, it was found that there was a lack of collegial decision-making by the KLP in this case.

Veliaj refers to letter no. 413/3 prot., dated March 11, 2025, signed by Gërmenji, where according to him it is stated that “the KLP reviewed the request”. He claims that this does not correspond to the real procedure followed by the institution.

The document argues that the law "On the Status of Judges and Prosecutors" gives only the High Prosecutorial Council the right to make decisions on the termination of the status of a magistrate.

For this reason, Veliaj considers the letter signed by the vice president invalid, arguing that a formal decision of the collegial body is missing.

The mayor also raises doubts about the representation of the KLP in the judicial process. According to him, the legal representative of the institution appeared in court without a mandate approved by the Council.

Veliaj asks the members of the KLP to clarify whether they were aware that Erind Gërmenji had personally reviewed and decided on the issue related to the status of prosecutor Ols Dado.

Veliaj's reaction comes at a time when the Administrative Court is examining the way in which Ols Dado was appointed Prosecutor, without having a Magistrate's degree. Veliaj states that a prosecutor's career is not protected by avoiding public scrutiny over the legality of his mandate, but by publicly proving that that mandate was obtained in accordance with the law.

At the Administrative hearing, Veliaj and his defense attorney, Plarent Ndreca, said that the KLP is trying to close the process procedurally so that the court does not examine the merits of the case.

" This very trial, where we are today, is another proof of this absurd paradox. Because even today, the opposing party, in essence, does not ask the court to examine my claim on the merits. It asks that the court not enter into the merits of the case at all. It asks that you, Mr. Judge, not examine the legality of the power that was exercised over me and over the institution that I represent," Veliaj continues.

"It seems like there is institutional coordination and they want to protect Dado at all costs. The KLP is the body most interested in the truth, the KLP should have become a party to the lawsuit with us to verify whether Dado exercises authority based on the constitution. What is being said in court is the fact that they have coordination for the protection they provide to Dado ," said Ndreca, Veliaj's lawyer. /Pamphlet/
