The members of the Constitutional Court did not issue a decision in today's session regarding the request filed by the association of judges and prosecutors, who are requesting a reassessment of their salaries.
The members of the Constitutional Court have requested more time to make a decision, which means that they have not managed to secure a majority of at least 5 members to reach a decision.
This is a well-known practice for the Constitutional Court, whenever its members are divided 4 by 4.
Rama's clash with judges and prosecutors
The request has been strongly opposed by Prime Minister Edi Rama, who in public statements has asked the Constitutional Court not to take into account what the Head of Government considers "chickens on a skewer."
"Once again, the issue of judges' salaries has remained on the agenda, there have been comments, oddities that have accompanied the debate, in addition to two associations, one of judges and one of prosecutors, the judges have placed themselves in the eye of the popular cyclone, in relation to a popular dissatisfaction, for the demand for a salary increase, this related to the internal survey where 90% are against the salary increase and some think that their salary should be reduced, because they are thoughtless and unfair. Meanwhile, the judges think that their salary should be increased.
"Voices say that their salaries are decreasing, that the salaries of others are increasing. What we have done for the justice reform has been the expression of strong will regarding their salaries, they will be paid extra with our sacrifice, that after they pass the vetting they will face the independence of the judicial power, the challenge, based on the values of the constitution, democratic life, in the service of citizens and guarantor of the service of the law, " said Rama.
But the debate did not stop there, as it was the complainants in the Constitutional Court who responded to the Prime Minister.
"The Prosecutors' Association of the Republic of Albania, in the context of recent developments and the public debate about the constitutional judgment on the salaries of magistrates, in fulfillment of its mission and activity, considers it necessary to express an official position in order to protect the principles of the rule of law and the independence of the justice system.
The Association of Prosecutors of the Republic of Albania joins the public positions and research already exhaustively argued by the associations of judges before the Constitutional Court. We emphasize that any legal change that leads to a regression in previously recognized standards and a reduction in the salaries of magistrates constitutes a violation of constitutional guarantees.
Shoqata e Prokurorëve të Republikës së Shqipërisë shpreh besimin e saj të plotë në Gjykatën Kushtetuese si autoriteti i vetëm legjitim për të dhënë fjalën përfundimtare në këtë proces, si dhe mbështet çdo përpjekje institucionale dhe civile që synon forcimin e rendit kushtetues, pavarësinë e sistemit të drejtësisë dhe mbrojtjen e standardeve demokratike në vend”, thuhet në reagimin e Prokurorëve.
Ndërkohë shoqata e gjyqtarëve në një reagim akuzon Ramën për tymnajë populiste.
“E gjithë kjo tymnajë populiste është krijuar dhe shpërndarë me qëllim linçimin e gjyqtarëve dhe shoqatave të tyre”, thuhej në deklaratë.
“Në gjithë këtë fushatë qeveritare dhe të shumëzuar mediatikisht, të nxitur dita-ditës për të krijuar furinë populiste kundër një procesi gjyqësor kushtetues, duhet që të përmenden disa fakte historike, të cilat neglizhohen për t’u cituar, qëllimisht nga disa dhe nga padijenia e mirëkuptueshme e të tjerëve”, thuhet në deklartë që ndalet në ligjet e vitit 2016 ku theksohet se parashikimet kanë qenë që statusi financiar i pagës së magjsitratëve do të ishte gati një e treta në vlerë absolute e asaj se çfarë u miratua në Kuvend në nëntor të vitit 2026 pa debat.
“Përmes këtij reagimi kërkojmë që të përcjellim publikisht se të gjitha iniciativat civile dhe kushtetuese të shoqatave të gjyqtarëve nuk kanë si qëllim “rritjen e pagës”, një term ky i zgjedhur qëllimisht, i gënjeshtërt dhe spekulant, vetëm e vetëm për t’i kundërvënë procesit gjyqësor kushtetues populizmin, si armë e pafuqisë juridike dhe e fuqisë së përbaltjes.”, thuhet më tej në deklaratë. Shoqata Kombëtare e Gjyqtarëve e akuzon qeverinë se e ka prerë në besë dhe se iniciativa tregon sipas tyre, se është qeveria që kërkon të çbëjë nenin 138 të Kushtetutës dhe ta shndërroj procesin gjyqësir kushtetues në gjyq popullor”, thuhet në reagimin e Shoqatës së Gjyqtarëve.

Në mars të vitit 2025, Unioni i Gjyqtarëve kërkoi shfuqizimin e ndryshimeve ligjore që u bënë për pagën e tyre në vitin 2023, ku u përcaktua se rroga bazë e magjistratëve do të ishte sa 36% e pagës së Presidentit, pra 153.000 lekë.
Më herët referenca mbi të cilën llogaritej rroga ishte 132,100, aq sa ishte paga e drejtorit të departamentit në Kryeministri.
Pra me ndryshimin e ligjit nga qeveria rritja ishte me mbi 20 mijë lekë të reja.
Por kjo rritje u konsiderua si ulje nga ana e gjyqtarëve. Kjo për shkak se në të njëjtën kohë, qeveria rriti pagat për administratën publike. Dhe paga e drejtorit të departamentit në Kryeministri u rrit në 231 mijë lekë të reja.
Pra gjyqtarët thonë se ndryshimi i referencës së pagës së tyre nga ajo e drejtorit të departamentit në Kryeministri te ajo sa 36% e pagës së Presidentit, ua ka ulur pagën dhe nëse s’do bëhej ky ndryshim ajo do të ishte 78 mijë lekë të reja më e lartë.
For this reason, the judges are requesting from the Constitutional Court either a return to the first reference or a determination of 54.3% of the President's salary plus a reflection of any salary increase in full.
Considering the formula for calculating the salaries of judges and prosecutors according to the law, the increase ranges from 1,800 euros for first-instance magistrates, up to 3,000 euros plus for the Appeal of the GKKO and SPAK. /Pamphlet/
