New details have been revealed regarding the arrest by order of SPAK of the head of the Chamber of Advocates of Korça, Arben Lena, which took place within the framework of a wide operation for corruption in the Court of Korça, after the arrest of two people for clandestine trafficking .
One of them was accused of their trafficking and the other of "not reporting a crime".
It is learned that while Lena's former assistant was under surveillance by SPAK, she called him asking about two envelopes that were in the office.
During the communication, the assistant was instructed to keep one of the envelopes in the office and deliver the other to the family members of an arrested person, for whom the Appeal had confirmed the security measure of "prison arrest". SPAK claims that this envelope would be used to bribe an Appellate judge.
But why did the other envelope have to be kept in the office?
It is known that while under surveillance, Lena's assistant had represented the Attorney's office in a court session where the security measure would be given to two arrested persons. After the hearing, one of them had a lighter security measure, while the other remained in prison.
The prosecution has doubts that the discussion about the envelopes is related to this court session and the security measure.
From the preliminary data, it is suspected that the envelope with 5,000 euros was kept after the security measure was eased for the first detainee and the other one was handed over to the family members, since the second detainee remained in the cell.
In December 2023, SPAK ordered the arrest of five persons for the criminal offenses of "Exercising illegal influence on persons exercising public functions" and "Crime prevention", provided by articles 245/1, points 2 and 4 of 300 Criminal Code.
Lena's former assistant is also among those arrested.
The event shocked the Court of Korça, while investigations continue even after the arrest of Arben Lena.
"From the investigations carried out up to this stage of the investigation, reasonable suspicion has been created that the citizens of DK, NH, NJ, BK and AK, in cooperation with each other, have consumed the elements of the criminal offense of "Exercising illegal influence on persons who exercise public functions" in the form of seeking the irregular benefit of an amount of 5000 (five thousand) euros with the aim of exerting influence on the Korçë Court of Appeal to mitigate the security measure of the BK citizen, who was investigated for the alleged criminal offense from article 298 of the Penal Code. The DT citizen is suspected of having committed the criminal offense of "Discrediting the crime", provided for by Article 300 of the Penal Code" , SPAK announced in December 2023.
