The Durrës Prosecutor's Office, as part of the investigations it is conducting into the recent floods in this city, has seized a series of documents and files from the Municipality regarding procedures and tenders related to the field of infrastructure.
More specifically, Prosecutor Suela Beluli has ordered the seizure of all documentation from the Municipality of Durrës related to the procurement, implementation and handover procedures for the rehabilitation of the embankment, the construction of the jetty and the arrangement of the Erzen River, as well as the technical and legal documentation of the construction permit for this facility.
According to the decision, the seizure of documents will be carried out by the judicial police officer, while a copy of the decision has been made available to the Municipality of Durres.
Meanwhile, the prosecution has registered criminal proceedings for the criminal offenses "Destruction of property by flooding", "Destruction of property by negligence" and "Abuse of office".
The investigations began following the situation created by the floods, the order to evacuate residents, and public denunciations on social networks and the media, regarding interventions for the rehabilitation of the Erzen River embankment.
On January 8, the Durrës Prosecutor's Office announced that the registration of this criminal proceeding came after the situation created over two days, where due to continuous rainfall, real, visible problems were created for individuals, for their well-being, but also considerable damage.
"The situation that has created, which has prevented the normal development of educational, state, and health activities, has created the blockage of urban and interurban roads, the flooding of homes and the real danger to the lives of citizens, the flooding of the penitentiary institution, placing the entire district in which the Prosecutor's Office of the First Instance Court of General Jurisdiction of Durrës exercises territorial and subject jurisdiction in a state of emergency, provides sufficient and reasonable evidence that we are facing a criminal fact."
Also, from the data so far, it results that as a result of this situation, it is suspected that the death of citizen AH, who turns out to be an employee of the Municipal Enterprise Plazh, has occurred. From the preliminary data, there are suspicions that he lost his life because he was swept away by the water flow caused in the place.
Under these conditions, in order to delve deeper into the causes that led to the occurrence of these consequences and to analyze exhaustively whether the causes were entirely natural or resulted from negligence or failure to fulfill their duties by the competent state bodies or local self-government, the initiative is taken to register this criminal proceeding. Meanwhile, further investigation will provide correct conclusions on the existence or non-existence of criminal liability,” the Prosecution announced.
The rehabilitation of the Erzen River embankment began in September 2021 with the aim of preventing floods.
At that time, Mayor Emiriana Sako stated that "we have begun work on the rehabilitation of the Erzen River embankment in order to avoid flooding in this area."
