Under investigation for "abuse of office" and "destruction of property"; one victim, over 1,000 affected families and tens of millions of euros at stake
The Durrës Prosecution Office has launched an investigation mainly after the serious situation created by the rainfall of the last two days, where the city and surrounding areas were flooded, while a 54-year-old man lost his life. The prosecution is investigating suspicions that the massive floods, with about 250 hectares of land under water and over 1,000 families damaged, are directly related to the malfunction of Hidrovor.
The investigation includes the criminal offenses of “destruction of property by flood”, “destruction of property by negligence”, and “abuse of office”. According to the Prosecutor’s Office, there are reasonable suspicions that persons with public functions have committed actions or omissions that have led to serious consequences for public and private property, as well as the loss of a citizen’s life.
Also in the spotlight is the tender for the construction of the new Hidrovor, worth 19 million euros, won by the merger of the companies 2T, Adriatik and the Hysa Brothers. The Adriatik company is 50 percent owned by Petrit Kovaçi , the father of Spartak Kovaçi, former General Director of the Water and Sewerage Company.
According to Open Data, the 2T company is 20 percent owned by Artan Sako, brother of Gramoz Sako , currently mayor of Tepelena and former head of the Republic Guard. These connections have raised serious suspicions of conflict of interest and lack of control over the implementation of the contract.
Preliminary investigations show that the death of citizen AH, an employee of the Municipal Enterprise Plazh, is suspected to have been caused by a strong flow of water. He had gone to the area to verify the situation created by the rainfall. The prosecution is verifying the responsibilities of the structures that were responsible for the maintenance, control and management of the emergency, while the file is expected to be expanded with specific names in the coming days. /Pamphlet

From the information so far, it results that as a result of this situation, it is suspected that the death of citizen AH, who turns out to be an employee of the Municipal Enterprise Plazh, has also occurred. According to the information, it results that this citizen went to the area to verify the situation created by the rainfall and flooding. From the preliminary information, there are suspicions that he lost his life because he was swept away by the water flow caused in the place.
In the circumstances of how the loss of life of this citizen occurred, based on the circumstances learned up to this moment personally and through the media, it results that there are reasonable doubts about the existence of the criminal offense of "Abuse of office" provided for by Article 248 of the Criminal Code, committed by the persons responsible for the maintenance, control and management of the situation created due to the rainfall, in the city of Durrës.
There are suspicions that persons in charge of functions, who are tasked with managing the situation, have committed actions or omissions that constitute a failure to properly fulfill their duties, severely damaging the interests of citizens and legal entities and have also brought serious, evident and measurable consequences on property assets as well as on the life of a person who has lost his life.
Likewise, based on the significant damage evidenced so far that has been caused to public infrastructure as well as private property, there are reasonable doubts about the existence of the criminal offense of "Destruction of property by flooding" and "Destruction of property by negligence" provided for in Article 153 and Article 161 of the Criminal Code.
