Renowned lawyer Saimir Visha has raised strong concerns about the functioning of the justice system, focusing on the salaries of judges and prosecutors, the independence of SPAK and the lack of security in the courts. He made the statements in an interview for Klan News, this Tuesday, on the show moderated by Besard Jacaj.
According to Visha, increasing salaries for judicial employees is necessary, due to the large volume of work and responsibility they bear. He emphasized that higher salaries do not eliminate corruption, but help to reduce it, by giving judges and prosecutors economic security.
" Judges today have salaries ranging from 2 thousand to 5 or 6 thousand euros, but for the workload they have, this salary is low. They have voluminous files that must be read carefully, because appeals are made at several levels of judgment. For this volume of work, they deserve a salary increase ," said Visha.
He added that not only judges and prosecutors, but also the court administration deserves a salary increase, as they work around the clock and in emergency conditions, especially in administrative courts, where, according to him, the file situation is more problematic.
The lawyer also expressed concern about political interference in the justice system. According to him, the separation of powers still does not function properly, while the justice reform has produced serious consequences.
" This reform was murderous. We removed professional individuals and today we have patronage agents. The Assembly visits SPAK and this is not okay. Powers are separated. The government has 84 votes and theoretically it could go as far as dissolving SPAK or changing it ," warned Visha.
The focus of the interview was also the issue of security in the courts, especially after the serious events that have occurred over the years, including the murder of Judge Astrit Kalaja in the courtroom. Visha said that security in justice institutions is at very low levels.
" In Albania, all parties enter the court through the same door. This does not happen in any European country. We need security in the courtroom and in the corridors. The security officers are old, with ridiculous salaries. We need a specialized corps ," he said.
Visha also criticized the practice of keeping defendants in glass cages, describing it as abnormal and detrimental to the right to defense. According to him, the defendant should be able to communicate freely with his lawyer during the hearing.
