"Pyramid of microcredits"/ Thousands of Albanians were extorted, MCA:

The company "MCA Albania" claims that the media and the Prosecutor's Office have ruined its image, while the microcredit company is suspected of being at the center of the "financial pyramid", through which thousands of Albanian citizens have been deceived with the abusive scheme of abusive interest.

These claims were raised before the Administrative Court of Appeal, where "MCA" failed to recover the activity license, which was revoked by a decision of the Bank of Albania in June of this year.

"As far as the actions undertaken by the prosecution, or the news that circulates in the media, they are actions, which in fact, in themselves are acts that seriously and unfairly damage the reputation of the plaintiff party (MCA) and its partner (Elda Ibro ), and, in the event that they will not be substantiated by a final court decision, they will constitute a claim for compensation for the great damage they have caused", the defense stated of the microcredit company in a court session.

"MCA" appealed to the Court of Administrative Appeals in September 2024, where it requested the annulment of the Bank of Albania's decision to revoke the commercial license

The Bank of Albania, in June last year, decided to revoke the license of the company "Mikro Credit Albania-MCA", following numerous violations, as well as for the "bad reputation" of the partner/partners, after the arrests of carried out by the Prosecutor's Office of Tirana, earlier, in May 2024.

The Court of Administrative Appeals, in a decision taken on December 19, 2024 and disclosed on December 27, decided to return the documents to the "MCA" company, since the formal elements of the lawsuit were not met.

According to the court decision, it turns out that the lawsuit was submitted in September 2024 by a legal representative, authorized by the partner Elda Ibro, as well as by the partner herself.

The law on commercial companies provides that the company (legal entity) is represented by the administrator. At the time of filing the lawsuit, the administrator of "MCA" is an official designated by the Agency for Seized and Confiscated Assets, after the Tirana court had accepted the request of the capital's prosecutor's office to place the company under sequestration.

But, in the lawsuit submitted in September to the court, it turned out that the authorized representative of the Ibro partner was another person and not the official administrator.

The court has previously asked the partner of "MCA" to fix this defect. But, in the absence of a reaction, the trial body decided to restore the acts, deciding to suspend the case.

Whereas, regarding the request of the partner Elda Ibro, the Administrative Court of Appeal decided not to accept the lawsuit, as it assessed that it is not legitimate, because the consequences of revoking the commercial license fall only on the company "MCA" and not on the individual who is the owner.

The microcredit company, "MCA", its counterpart "Final", as well as several enforcement offices, are part of an investigation for "fraud with serious consequences", pursued by the Prosecutor's Office of Tirana, Antoneta Sevdari, Ndini Tavani and Arben Agovi.

In December 2024, the Prosecutor's Office of Tirana announced its incompetence and transferred the case to the Special Prosecutor's Office (SPAK) to continue the investigations of the "structured criminal group".

Meanwhile, SPAK is also examining a material passed earlier for competence by the Prosecutor's Office of Tirana, where the role of senior executives of the Bank of Albania, including governor Gent Sejko and members of the Supervisory Council, is being evaluated. / "Boldnews.al"
