The American Senate has returned to President Joe Biden his proposed candidacy for ambassador to Albania. David J. Kostelancik was rejected, but it seems that there is still a glimmer of hope for him, to be an ambassador to our country.
In the letter addressed to the President, the Senate states that the rejection of the said name was made according to the provisions of Regulation XXXI of the Senate, paragraph 6.
This regulation and this paragraph talk about the return of names for issues of deadlines. Along with the name in question, many other candidates have returned. According to the paragraph, when the Senate takes a break for more than 30 days, it returns all candidacies to the president. But the latter has the right to re-propose the names in question, or if he can bring new names.
In the case of the ambassador, he has been blocked for a year. When the Senate starts the new session, it returns the pending candidacies. So, if Biden sees fit, he can re-nominate Mr. Kostelancik.
" Unlike a number of Senate rules that require proactive enforcement, nominations that have neither been confirmed nor rejected are automatically returned under Rule XXXI when the Senate has postponed voting or consideration has been suspended for a period of more than 30 days ," the Senate clarifies. .
Kostelancik's candidacy has been fixed for a year since it went to the Senate, and now the procedures will have to start from scratch. There have been cases when all candidacies were re-proposed in the Senate, thanks to political consensus.
If Biden re-proposes Kostelancik's name, he will have to accompany it with additional documents, including financial or personal data. The Senate can also ask for a hearing with him again, or be satisfied with the hearing held a year ago.
