The court has rejected the request to exclude Judge Marinela Osmani from the consideration of the case related to the request to discontinue criminal proceedings against Judge Irena Gjoka, charged with forgery of documents.
The decision was made by Judge Rudina Palloj, who assessed that there are no legal grounds that justify Osman's removal from the review of the file.
The request was filed by complainants Adriana Kalaja and Jamarbër Malltezi.
The two prosecutors have also requested that the review of SPAK's request to discontinue the investigation not be conducted at the GJKKO, arguing that this court is in a conflict of interest.
The investigation against Judge Gjoka was launched in June 2025 for the criminal offense of forgery of seals, stamps or forms, following denunciations made by the leader of the Democratic Party, Sali Berisha.
"In response to your request, the case is in the preliminary investigation phase. Based on Articles 103 and 279 of the Criminal Procedure Code, investigative actions carried out at this stage constitute an investigative secret. Referring to these articles, we cannot disclose the investigative actions or their results," SPAK announces.
SPAK has sent a request to the GJKKO to discontinue the investigations against the judge for the criminal offense of "Forgery of seals, stamps or forms".
SPAK announces that despite the fact that the materials administered show that Irena Gjoka used irregular documents and attempted to enter Greece using different identities, the criminal record issued by the Greek authorities does not contain any information about her conviction in the neighboring country.
SPAK also states that no documentation proving notification of the court decision against it has been administered, and there is no evidence of knowledge of the existence of this decision at the time it was issued.
SPAK states that it results that even if the existence of this criminal decision were taken for granted, the criminal prosecution regarding this fact results in being extinguished due to the statute of limitations, in accordance with the relevant applicable legislation.
The proceeding was registered on June 5, 2025, following a complaint filed by Adriana Kalaja, in her capacity as the chairwoman of the Appeal and Statute Evaluation Committee of the Democratic Party.
Through the complaint, she alleged forgery of documents, abuse of office and exercise of illegal influence by Gjoka.
