The Mayor of Tropoja, Rexhë Byberi, seems to have a very big problem with the approval or opening of new road segments in the territory of the institution he leads. A while ago, we showed you the first flagrant violation of Tropoja's number one, but it seems that Byberi has not stopped there.

The only question is whether these violations are committed with full will, from the arrogance of power, or ignorance?

In the first case, Mr. Byberi seems to be in serious violation of the law in the so-called 'Reconstruction of the road 'Grace-Logu i Gracit', Margegaj Administrative Unit'.

Imaginary reconstruction, because there was never a road in that place, except for a small path that was specified on the papers as a horse road...

According to the documentation, the residents' request for the expansion of this road was addressed to the municipality and the Margegaj Administrative Unit on May 20, 2021, and the public hearing in the municipal council was held on April 11, 2023. Meanwhile, the approval of this road was made on May 9, 2023.

In the letter made available by this institution, it was decided "Approval in principle of the project idea for the construction of the road 'Grace-Logu i Gracit' in the village of Shoshan of the Margegaj Administrative Unit with a length of 2450 linear meters".

Meanwhile, the drafting of the implementation project, the budget and others are entrusted to the Directorate of Planning, territorial development and the economic directorate.

The decision was signed by the Mayor, Rexhë Byberi, and the work started according to this draft idea approved by the council.

While the law no. 162/2020 'On Public Procurement' provides the rules for procurement procedures by authorities and contracting entities for public contracts and design competitions. In this context, Tropoja Municipality should not have avoided the implementation of this law and the road should have been built according to legal procedures....

In the meantime, let's not forget that the road is finished, despite these violations.

This case is only the tip of the iceberg for Tropoja's number one, as another allegation is even more blatant than the case we just published.

Ded Gjoli, a resident of the village of Palç, filed a criminal complaint against the mayor Rexhë Byberi for destruction of property on July 17, 2021. He claims to be the owner of the land from Qafa e Murriz to Qafa e Agri on which the road works were carried out.

The road is now completely open and goes through the forest.

Deda is determined to go to the end of this violation, but let's open the papers a little to understand if there really is a violation. The prosecutor, Artan Shtrunza, has taken over the criminal proceedings and the report-expertise proves Deda completely right.

The road stretches along plots 32/ab and 32/a of the forest economy "Nikaj Mertur 1". According to the forest cadastre, plot 32/b is a quarry and plot/a is a beech forest.

So, the expert, after being questioned by the prosecution, shows the exact coordinates of where the road was opened, but there is more...

'...The length of the axis of the road in question is 1110 m/l, of which 324 m/l are pastures and 786 m/l in the area of ​​forest trees. In the determination of the value in Lek for the opening of this road, it is noted that 88 pieces of the 10.1-20 cm diameter category and 35 of the 20.1-30 cm category were cut.

How much is the value of cutting these trees translated into lek?

For the diameter of 10.1-20 cm, a cut wood is calculated with an economic value of 8,000 Lek, while for the quantity in question, i.e. 88 cut trees, the value of the damage is 704.00 Lek.

For the 20.1-30 cm diameter category, the economic value of a cut tree is 15,000 lek, while for 35 damaged for the opening of the road it is 525,000 lek.

Exact summary only for felled trees, leaving aside the environmental damage in the crown of the forest, the value in Lek is 1229.00. But there are other economic damages from excavations...

For 1m/cubic meter of excavation for opening the road, the value in Lek of the damage caused is 49,500 Lek. The measurement of the road shows that its length is 1110 m/l, width 30, while the average slope is 2 meters. The value of the damage caused is 164,835,000 ALL, while the total value of the damage is 166,064,000.

This damage was ascertained by the independent expertise of the Prosecutor's Office of Tropoja... and approved with the signature of the Mayor, Rexë Byberi.

Let's not forget that the former mayor of Fushë Arrëzi, Fran Tuci, is today behind bars for such a violation, while the criminal proceedings against the mayor, Rexhë Byberi, sleep in the offices of the Tropoja Prosecutor's Office.

Why did the prosecution of Tropoja not delegate such a violation to SPAK and why was the investigation left in oblivion? Questions waiting to be answered... / Piranhas
