
The process for what is known as the 'Partizani' affair has begun at the GJKKO, for which SPAK has named former Prime Minister Sali Berisha, his son-in-law, Jamarbër Malltezi, Xhimi Begeja and Andia Pustina, as well as builder Fatmir Bektashi as defendants.
Lawyers for Berisha, Malltezi, Begeja and Pustina requested the invalidity of the acts presented by SPAK, thus aiming to close the process. Meanwhile, the lawyer for businessman Bektashi will present his claims at the next session. This session will be held on September 29, while former Prime Minister Berisha was not present at the session held today, while his son-in-law, Malltezi, was present.
Today's session lasted for about 3 hours, where at the beginning, the presiding judge, Elsa Ulliri, reported on the decision of Judge Erjon Çela who rejected the request for the exclusion of the trial panel made by Sali Berisha's lawyers.
During the hearing, lawyer Gjokutaj accused former US ambassador Yuri Kim of pressuring SPAK to prosecute Berisha.
"The prosecution has exceeded its constitutional powers in filing the charges based on opinions. Ambassador Kim has exerted pressure on SPAK to prosecute Berisha," said lawyer Genc Gjokutaj.
The same request was made by Klodjana Gjyzari, Berisha's other defense attorney, seeking the invalidation of the decisions made by the preliminary investigation judge, Irena Gjoka.
"Irena Gjoka's mandate should have ended in 2016. Irena Gjoka has been sentenced with a final decision. We have been informed that the document we submitted has been assessed as authentic by the General Prosecutor's Office. This shows that the decision against Irena Gjoka is true," said Gjyzari, according to the Report TV journalist.
The other defendants, Xhimi Begeja and Andia Pustina, also requested the invalidation of the floors, while businessman Fatmir Bektashi will present his requests at the next session, which will be held on September 29 at 11:00.
The Partizani affair case went to trial on May 19, a few days after the May 11 elections, and after being delayed for 7 months in a preliminary hearing. Berisha will be tried on charges of passive corruption of high-ranking officials, as he is accused of having, in his capacity as prime minister, taken concrete actions in approving laws and by-laws, where his son-in-law, Jamarbër Malltezi, was also a beneficiary.
Malltezi is also accused of corruption and money laundering. According to SPAK, he has illegally benefited from a construction business worth 5.4 million euros thanks to government decisions taken by his father-in-law.
Fatmir Bektashi is accused of corruption and money laundering, Malltez's partner and land heir Xhimi Begeja, and financier Andia Pustina, who handled the financial and legal affairs of the company "Homeplan", are accused of money laundering. In addition, three companies "Kontakt", "Homeplan" and "Studio Pustina" have also been sent to trial for money laundering.
