On October 31, the Constitutional Court will hold a hearing regarding Erion Veliaj's appeal against the decision to dismiss him from the position of Mayor of Tirana. Veliaj is expected to be present at the hearing, while previously the Constitutional Court suspended the decree of the President of the Republic that had set November 9 as the date for holding partial elections in Tirana, along with 5 other municipalities.
The Constitutional Court told A2 CNN that it has asked the General Directorate of Prisons to take measures to accompany Erion Veliaj to the public plenary session to be held this Friday, following the latter's request to be present.
The Constitutional Court suspended President Bajram Begaj's decree to hold local by-elections in the capital on November 9. The decision was made after Erion Veliaj appealed his dismissal as mayor of Tirana.
The Constitutional Court unanimously decided to refer the case of petitioner Erion Veliaj to a public plenary session on October 31, 2025 and to suspend the Presidential Decree for the part that sets the date of the elections in the Municipality of Tirana.
Veliaj was dismissed from the Council of Ministers at the request of the Tirana Municipal Council, on the grounds that he had been absent from work. Veliaj has been in detention since February of this year, after being accused by SPAK of corruption and money laundering.
In the session held on October 9, 2025, the Meeting of Judges of the Constitutional Court, chaired by Holta Zaçaj, decided that the implementation of the presidential decree would bring irreparable consequences in terms of the rights of local elected officials.
According to the decision, elections for the Municipality of Tirana cannot be held while the legality of the decision of the Council of Ministers that dismissed Veliaj is still under review, writes A2 CNN.
The court relied on Article 45 of the law on its organization, according to which, if the implementation of an act may bring irreparable consequences for state, social or individual interests, it may temporarily suspend it.
In this case, the judges concluded that decreeing elections for Tirana, before reviewing the legality of the dismissal, seriously violates the constitutional right of the local elected official and could create a dangerous precedent for the functioning of local institutions.
With this decision, the process for the elections in the Municipality of Tirana is officially halted, pending the conclusion of the constitutional review of the legality of Veliaj's dismissal.
The presidential decree has been suspended only for the part related to Tirana, while the rest of the elections for other local units remain in force.
