Former Prime Minister Sali Berisha's lawyer, Genc Gjokutaj, spoke to the media after the preliminary hearing for the "Partizani" file at the GJKKO was postponed again.
Gjokutaj stated after the hearing that the defense has requested the removal of Judge Flojera Davidhi for "marked bias" in her previous decision-making, describing it as unfair and unfounded in law.
Due to this request, the hearing was adjourned according to procedure, as the judge cannot continue the hearing without a decision from another available judge on the request for disqualification.
"Bringing you back to yesterday's information that we requested sufficient, rapid time to consult with our clients about the situation created after the decision of the preliminary judge regarding the invalidity of our research, we unanimously made a decision to request the disqualification of Judge Flojera Davidhi for pronounced bias in her decision-making. These are clear research based on the law and it is judicial chaos that, without explaining the reasons for the legality of our research, made an unjust decision. Today we filed a written request for the disqualification of Judge Flojera Davidhi and the session was interrupted according to procedure, because the judge cannot issue a decision without another judge being available to express his opinion regarding her decision-making," said Gjokutaj.
