The hearing on the "Partizani" case has been postponed again. The reason for this is the lawyers' request to disqualify judge Flojera Davidhi. The next hearing was scheduled for May 5th.
According to lawyer Genc Gjokutaj, the disqualification was requested due to the judge's marked bias in her decision-making. He stated after the hearing that the defense requested the removal of Judge Flojera Davidhi for "marked bias" in her previous decision-making, describing it as unfair and unfounded in law.
"These are searches based on the law and a judicial chaos, which without explaining the reasons for the legality or illegality of our searches made an unjust decision. Today we filed a written request for the exclusion of the judge and according to the procedure, the session was interrupted because the judge can neither make nor give a decision without another judge of this court expressing his opinion regarding her exclusion ," said lawyer Gjokutaj.
It is now up to the GJKKO to decide whether or not the file in question will go to trial, after about 6 months from the moment SPAK filed it with the Court.
On trial in this case are former Prime Minister Sali Berisha, his son-in-law, Jamarbër Malltezi, and 3 other people.
