Former prosecutor Eugen Beci has commented on SPAK's request to the Assembly for the removal of Berisha's immunity.
Beci emphasizes that the Court should have made such a request from the first measure against Berisha.
"Parliament is the one that must decide if it will enter the logical and Constitutional interpretation. The Prosecution and the Court got into a storm of this kind in vain, because you could have asked for the authorization from the beginning, that is, from the first measure. These deputies who will examine such an authorization from the Special Prosecutor's Office should also think about themselves", said the former prosecutor.
He also spoke about the criteria for the "House Arrest" security measure, adding that such a measure can only be applied in the apartment where the person lives.
"House arrest belongs to the category of security measures that is equal to prison arrest. Regarding the conditions and features that house arrest should have, they are decided case by case by a Court which assesses the criminal offense and the dangerousness of the person.
Usually the provisions of the criminal procedure code when a security measure is set by a Court for a citizen, are such that the citizen is invited to declare his residential address. His residential address, in case it has to be proven with a certificate of ownership, must definitely be a residence," Beci told "Euronews Albania".
