The GJKKO decided to return the case related to Irena Gjoka, the former head of the Special Court, to SPAK for investigation.

Gjoka is suspected of failing to declare on the decriminalization form a criminal conviction issued by Greek authorities for using a forged visa.

If this is proven by the Albanian authorities, Gjoka risks not only the interruption of his career in the justice system, but could also face a criminal sentence.

SPAK requested the closure of the case at the GJKKO, but the latter has ordered the Special Prosecution Office to continue the investigations, even defining tasks that must be completed within 6 months.

GJKKO Judge Marinela Osmani decided to return the file to SPAK for further investigations, assigning 20 investigative tasks that SPAK had not completed in Irena Gjoka's file.

Lawyer Genc Gjokutaj, who also defends former Prime Minister Sali Berisha, commenting on the GJKKO decision, said that it puts the case back on track and is a legal response that reveals many aspects of the investigation into this matter.

"The GJKKO placed SPAK in charge of investigating this matter, one of the most important issues regarding not only the investigation, its quality, but also the integrity of the GJKKO," said Gjokutaj.

Irena Gjoka has been reported by Adriana Kalaja for concealing her conviction on the decriminalization form. In 2005, she was stopped at the border with irregular documents and sentenced in Greece to 3 months in prison, converted into a fine of 1,500 euros.

SPAK requested the dismissal of the case, acknowledging that Irena Gjoka was convicted but claiming that she was unaware of her conviction and therefore could not be tried.
