The Prosecutor's Office of Vlora has read in court the final claim against three Vlora mortgage officials and the merchant Helidon Gjikoka, who, according to the investigation file, through "Forgery of documents and forms", "Abuse of duty", brought about the alienation of a land surface through fraud of 1430 m2 of land located in the "Perivollo" area of Dhërmi.
Ora News has learned that Edmond Vorfi, the prosecutor of the case, initially requested a sentence of 3.4 years of imprisonment for the merchant Helidon Gjikoka, for the charge of "Forgery of seals and forms".
Again for Gjikoka, the prosecutor demanded 3 years imprisonment for the charge of "Forgery of documents".
But in combining the two sentences and the shortened trial, prosecutor Vorfi asked for the final sentence of two years of imprisonment for Gjikoka.
Vorfi requested the same measure of punishment for the lawyer Ariton Kasaj, for whom a sentence of 2 years of imprisonment was requested.
The prosecution demanded 1.4 years of imprisonment for Andi Haxhiaj and Ermal Mahilaj, who are accused of the criminal offense of "Forgery of documents".
Meanwhile, the prosecutor Vorfi, during the reading of the claim, expressed himself by withdrawing the charge of "Fraud" for the defendants Helidon Gjikoka, Ariton Kasaj. The prosecution withdrew the charge as "Misuse of duty" for the defendants Enida Bukuroshi and Jonida Hallvaxhiu.
The prosecution's withdrawal of the charge of "fraud" was done in open opposition to a decision of the Vlora Court of Appeal and the Supreme Court, which directs the prosecution to continue investigations into this criminal offense as well.
Also in his claim, the prosecutor asked the Vlora court to compel the Vlora Cadastre Agency to make the note "falsified" on the documents extracted with the fake expert report.
According to the investigation file, it is about a land area of 1430 m2, located on the front line of the "Jon" sea coast, which was obtained according to law 7501 by the citizen Ahilea Koka.
Then the latter, in August 2007, donated it to the citizen, Ilir Koka, in his will.
The investigation has proven that on the property with no. 36/9 which is owned by Ilir Koka, the latter has built several holiday cabins and which were then rented by his cousin, Helidon Gjikoka, from the city of Vlora who named the complex of 12 buildings with the name "Ambel Beach ".
The lease contract dated September 27, 2018, was apparently signed before the notary Saimira Hoxha, between Ilir Koka and Helidon Gjikoka.
But the prosecution from the conducted investigation shows that another person who is a lawyer signed on behalf of Ilir Koka in this case.
According to the prosecution, this contract expires on August 31, 2021 and Helidon Gjikoka must leave the facility.
But the investigation carried out by the prosecutor's office of Vlora, has revealed that Helidon Gjikoka submitted to "ALUIZNI" request no. 2286 in order to legalize in his name 12 buildings built on the surface of 1430 m2 of land.
The investigation has proven that since January 28, 2019, these assets are owned by Helidon Gjikoka, this is proven by the Mortgage certificate issued on the same date by Vlora Mortgage, which registered the property on behalf of Helidon Gjikoka. The illegal actions for the alienation of this property were carried out by the mortgage officials and ALUIZNI Vlorë, in cooperation with other persons in the central mortgage in Tirana.
