The Supreme Court has rejected the claims of Fredi Beleri and the Greek government, that the Directorate of Prisons does not allow him to be sworn in as the mayor of Himara.
Athens has threatened the Albanian government several times, accusing it of blocking his oath through the Directorate of Prisons, but the Supreme Court has resolved this conflict. In the decision released today, the court states that it is only up to SPAK and the Special Court to decide whether or not Fredi Beleri should be allowed to take the oath. It is also said that neither the Court of Durrës nor the Directorate of Prisons has the competence to make a decision.

"The access of the head of the Durrës detention facility to assess the conditions of application of this permit is almost non-existent", the decision states.
The court adds that as long as the case is in the Anticorruption Court, the request cannot be examined by another body beyond the court that has the trial on the merits.
Fredi Beleri was arrested for the May 14 elections. Special investigative actions revealed that on the eve of the voting day, he was involved in the vote buying scheme.
The money was paid by his associate to the citizen who was told that for this work he would be rewarded with 300 euros and the court has so far refused Beler's request to swear and to leave the cell.
On July 15, Beleri lost his battle with Albanian justice to leave his cell. The Supreme Court overthrew Fredi Beleri, leaving in effect the prison sentence given by the Special Court of Appeal.

His arrest has provoked the reaction of Athens, which insistently demands his release, stating that his arrest has political connections.
