Two plots of land called "Vllatorja" and "Moskato", which are located in the area of Himara, have a financial value of 1 million euros.
The illegal use of these two properties was discovered by a report made in 2022, by the teacher of the 9-year school in Himare, Irakli Likoka.
The case was first investigated in Vlora and then the case was transferred to SPAK, leading yesterday to a second arrest of the former mayor of Himarë, Jorgo Goro.
Meanwhile, as the investigations into this case continue, the criminal situation seems to be shaking for Arqile Bollanon, the current mayor of Himare, and another employee named Oleg Goro, who, together with Bollanon, has been part of the work group that has compiled the list of persons benefiting from the land in the form of the actual user.
Bollano and Oleg Goro, compiled false documents, which were then signed by the mayor of Himarë, Jorgo Goro, unjustly making the municipal official, Arqile Bollanon, and several other people the owner.
But apart from giving Bollano ownership, the latter, through a private property survey plan, has made a map overlay for the "Vllatorja" gas station. This overlapping measure is calculated at 3742 square meters, extending the borders and over the property of the teacher Irakli Likoka.
Because Bollano also violated Irakli Likoka's private property, the latter filed a criminal complaint with the prosecutor's office on December 7, 2022.
Irakli Likoka has requested criminal prosecution for the citizen Arqilea Bollano for the criminal offense of "Forgery of documents" provided by article 186 of the Criminal Code, as well as for the employees of the Himarë Municipality and ASHK Vlorë for the criminal offense of "Abuse of duty".
Likoka explained that he inherited from his father, the late Niko Likoka, a 2.2 ha pasture area in the city of Himara. For this property, the Vlora Court, on July 11, 2023, decided to certify the legal fact of ownership.
Based on this decision as well as the archival documents available, the complainant requested the return of the property from the Property Handling Agency.
The complainant has become aware that on this land surface, it was treated with land owned by Arqile Bollano, who was provided with AMTP owned by Himarë Municipality, in 2016 and then registered the property at the State Cadastre Agency Vlorë in the year 2022.
According to Irakli, the AMTP in favor of the citizen Arqile Bollano was given in violation of the law for the reason that:
"...it was given to his property for which he has ownership documents and is also in the judicial process for its physical return. This area of land is pasture and is not agricultural land as such it cannot be given with AMTP...".
Regarding the facts denounced by Irakli Likoka, the prosecution requested information from the Himar Municipality, which on January 12, 2023, provided information that based on the request and documentation presented by Arqile Bollano, he was treated with decision no. .52, dated May 4, 2016 of the Himarë Municipal Council, as the actual user of the agricultural land, for the plots "Moskato" with an area of 517 m/2 and "Vllatorja", with an area of 4263 m/2.
For the "Vllatorja" plot, the Arqilea Bollano family was issued by the Himarë Municipality, Land Acquisition Act no. 11, on August 25, 2016.
According to this information addressed to Himara Municipality, information compiled and signed by citizens Arqilea Bollano and Oleg Goro, a meeting was held with the actual users of the agricultural land and based on the compiled list and relevant documentation submitted by each citizen and their verification, the working group agrees to continue the procedure to be equipped with AMTP.
On the basis of this documentation, Arqile Bollano applied to ASHK Vlorë, where this institution then carried out the registration of the above property in the name of Bollano.
After becoming aware of this registration, Irakli Likoka submitted a request on October 3, 2022 to ASHK Vlora, for the imposition of a temporary restriction, among other things, for this property. Based on the request of Irakli Likoka, the registrar of DVASHK Vlorë has decided to limit actions on assets.
It turns out that Arqilea Bollano was previously treated with agricultural land owned according to AMTP no. 19441/1996 and therefore he did not meet the legal criteria to be treated with agricultural land./Oranews
