Judge Astrit Kalaja was executed in the courtroom of the Tirana Court of Appeal, just after he had pronounced a decision related to a property dispute. The judge was shot with at least 3 bullets, while Kalaja lost his life a few moments after the assassination. The perpetrator of the crime, Elvis Shkambi, entered the Court of Appeal armed, while after the crime he calmly awaited arrest in the courtyard of the building.
The entire criminal event, beyond the shock of public opinion, raised many questions regarding the safety of magistrates in the Courts. Such a crime, namely the murder of a judge in a courtroom, is an unprecedented case, which has not happened in any country in Europe, or beyond, not even by the Italian mafia.
A day after the crime, an official reaction from the Supreme Court of Kosovo has shed much light on whether the event could have been prevented, how security measures worked, and why the State Police is absent from the interior.
Documents published by the Supreme Court of Justice show the continuous requests addressed to the State Police since 2023, asking them to guarantee security in the Courts, even in the courtrooms. The requests were made at a time when concerns were raised by the judiciary regarding the lack of security, which affected not only the quality but also the smooth running of the work and court sessions.
More specifically, in one of the letters, assessing that courts are objects of particular importance, the Council has repeatedly warned that the lack of effective police presence in courtrooms creates a serious risk to the safety of judges, staff and the public.
With letter no. 5489/1 Prot., dated 02.11.2023, addressed to the State Police and for the information of the Ministry of Interior, the Council has requested the increase of State Police employees in the internal premises of courts and courtrooms during the conduct of hearings.
But in its response, with letter no. 9683/3 Prot., dated 11.12.2023, the State Police announced that "we are currently unable to increase and plan the number of police officers to secure the internal premises of the courts and during court hearings, due to the limited number of police personnel."
Pas kësaj përgjigjeje, Këshilli i Lartë Gjyqësor, me shkresën nr. 5489/3 Prot., datë 15.12.2023, i është drejtuar zyrtarisht Ministrisë së Brendshme, duke kërkuar ndërhyrje urgjente: “duke marrë shkas nga ngjarjet e fundit të kërcënimeve ndaj gjyqtarëve, si pasojë e ushtrimit të detyrës, kërkojmë marrjen e masave për shtimin e organikës dhe planifikimin e punonjësve të Policisë së Shtetit për sigurimin e ambienteve të brendshme të gjykatave dhe prezencën e tyre gjatë zhvillimit të seancave gjyqësore publike.”

Këshilli i Lartë Gjyqësor shpreh edhe njëherë dhimbjen më të thellë dhe indinjatën më të madhe për ngjarjen tragjike të ndodhur, ku në ushtrim të detyrës, gjyqtari Astrit Kalaja humbi jetën brenda sallës së gjyqit.
Ky akt i rëndë përbën një sulm ndaj vetë themeleve të drejtësisë, ndaj autoritetit të gjykatës dhe ndaj rendit kushtetues të Republikës së Shqipërisë.
Këshilli i Lartë Gjyqësor, në emër të gjithë trupës gjyqësore të vendit, shpreh ngushëllimet më të ndjera familjes, kolegëve dhe komunitetit të gjyqtarëve, duke theksuar se drejtësia nuk mund të gjunjëzohet nga dhuna.
Në këtë situatë të rëndë, Këshilli i Lartë Gjyqësor u mblodh sot në mbledhje të jashtëzakonshme, për të shqyrtuar rrethanat e ngjarjes dhe për të analizuar masat aktuale të sigurisë në gjykata.
Në përfundim të mbledhjes, Këshilli vendosi të bëjë publike të gjitha shkresat dhe korrespondencën zyrtare që ka zhvilluar me institucionet përgjegjëse për garantimin e sigurisë në ambientet gjyqësore, me qëllim transparencën dhe informimin e publikut.
Këshilli i Lartë Gjyqësor informon se, në të gjitha gjykatat e Republikës së Shqipërisë, Policia e Shtetit aktualisht ofron shërbimin e saj vetëm me një punonjës në hyrjen kryesore ku lëvizin palët dhe publiku.
Në zbatim të pikës 2 të VKM Nr. 333, datë 28.04.2010, “Për ruajtjen dhe sigurinë e objekteve shtetërore”, gjykatat duhet të ruhen nga punonjës të Policisë së Shtetit, për të garantuar rendin dhe qetësinë gjatë seancave gjyqësore. Jashtë orarit zyrtar, ruajtja kryhet nga “Illyrian Guard”, e cila është një kompani shtetërore në varësi të Ministrisë së Mbrendshme.
Duke vlerësuar se gjykatat janë objekte të një rëndësie të veçantë, Këshilli ka paralajmëruar në mënyrë të përsëritur se mungesa e prezencës efektive të policisë në sallat e gjyqit krijon risk serioz për sigurinë e gjyqtarëve, stafit dhe publikut.
Me shkresën nr. 5489/1 Prot., datë 02.11.2023, drejtuar Policisë së Shtetit dhe për dijeni Ministrisë së Brendshme, Këshilli ka kërkuar shtimin e punonjësve të Policisë së Shtetit në ambientet e brendshme të gjykatave dhe sallave të gjykimit gjatë zhvillimit të seancave.
Në përgjigje, me shkresën nr. 9683/3 Prot., datë 11.12.2023, Policia e Shtetit ka njoftuar se “aktualisht e kemi të pamundur shtimin dhe planifikimin e punonjësve të policisë për sigurimin e ambienteve të brendshme të gjykatave dhe gjatë zhvillimit të seancave gjyqësore, për shkak të limitit të kufizuar të personelit policor”.
Following this response, the High Judicial Council, with letter no. 5489/3 Prot., dated 15.12.2023, officially addressed the Ministry of Interior, requesting urgent intervention:
"Taking into account the recent incidents of threats against judges, as a result of the exercise of their duties, we request that measures be taken to increase the number and planning of State Police employees to secure the internal premises of the courts and their presence during public court hearings."
At this difficult moment for the justice system, the High Judicial Council appeals for immediate institutional responsibility from law enforcement and executive bodies to guarantee the physical safety of judges and all participants in judicial processes.
Such events cannot be treated as isolated cases, they require a strong, systematic and coordinated response, so that a loss of life in the courtroom, the place where justice should be upheld, not overthrown, is never repeated.
