From Saranda comes a story that should not be passed over in silence, but should become an object of study and definitely an object of investigation for all those who want to understand why justice in Albania does not work. At the center of this story is a name that is not a little twisted in modern justice, Esmeranda Basho, a prosecutor, but above all, a model of how the power of a public official can be abused in the most unscrupulous way to protect personal and family interests.

In one of the most shocking cases to hit the Albanian justice system in recent years, it is revealed that Saranda prosecutor Esmeranda Basho used her high public position to manipulate investigations into a serious criminal case, turning justice into a tool to protect family members and hide evidence.

On December 5, 2022, in the city of Saranda, the vehicle of citizen LL was attacked with TNT, a serious act of terror and violence that required immediate response and impartial investigation by the responsible institutions. But the tragedy of this case was deepened by the way the investigation was conducted, in the hands of persons with close family ties and suspected interests.

The judicial police officer in charge of the investigation, Mariglen Basho, is the son of the uncle of prosecutor Esmeranda Basho. This fact constitutes a clear conflict of interest that the law categorically prohibits in order to guarantee the impartiality and integrity of criminal investigations. However, this clear conflict of interest was completely ignored by the prosecutor, who not only did not withdraw from the case, but took over the direction of the investigation by including the family in a key investigative position.

Meanwhile, it was revealed that Officer Mariglen Basho had concealed key evidence from the case file, including a crucial video identifying the car of the perpetrators of the TNT attack, evidence that could have been crucial to the full unraveling of the incident. This deliberate concealment of evidence is not only a flagrant breach of duty, but also a sabotage of justice that turns this investigation into a shameful farce.

After the video was broadcast on several portals, and after the scandal was published, Prosecutor Basho reacted in a paradoxical way: instead of seeking responsibility for her uncle's son, she filed criminal proceedings against the head of the Saranda police station, also requesting his suspension from duty. This action is a clear attempt to shift responsibility to another person, who in reality had nothing to do with the concealment of evidence and manipulation of the investigation.

Moreover, when the district prosecutor intervened to ensure legality and replaced prosecutor Basho from the investigation for conflict of interest, she refused to leave the case and appealed the decision to the High Prosecutorial Council (KLP). The KLP then itself established the existence of the conflict of interest and the violations that the prosecutor had committed, thus giving the institution that replaced her the right. However, despite this, Esmeranda Basho continued the investigation against the chief of the police station, keeping the responsibility away from her family and using the justice system to protect personal interests.

This case is a shocking testimony to the capture of justice by family ties and clientelism, showing how institutions that should be guarantors of law and order, in reality turn into tools to protect crime and target the innocent. This situation testifies to the complete degradation of the justice system, where the law is not enforced, but is used as a tool of manipulation by individuals with power and strong family ties.

Esmeranda Basho's actions violate every ethical and professional norm of the prosecution, questioning her integrity and severely damaging public trust in justice. She has abused her power, prioritizing family interests over the law and duty to the state and citizens. Instead of being the guarantor of law and justice, she has become an advocate for crime and a defender of the concealment of the truth.

In this alarming situation, silence and delays have become invisible accomplices of organized crime and state capture in Albania. Key institutions such as the High Inspectorate for the Declaration and Control of Assets and Conflict of Interest (HIDCPI) and the Prosecutor's Office, which should be immovable pillars of justice, are showing irresponsibility and a total lack of will to act.

The ILDKPI, an institution created precisely to combat conflict of interest and corruption in the judiciary, seems to have fallen into a lethargic sleep, avoiding its main task. Instead of immediately launching a full and impartial verification of the suspected actions of prosecutor Esmeranda Basho and persons associated with her, this institution is silent and protects more dark interests than the law. This shows how weak and trapped this structure is, dealing a major blow to the fight against corruption and clientelism.

At the same time, the Prosecutor's Office, which should be the bastion of honesty and independence, has shown no strong signs of taking this matter under independent and comprehensive investigation. On the contrary, experiences so far show that it tends to protect the families involved and cover up violations, becoming another mechanism that obstructs justice.

In the absence of a strong and impartial response from these institutions, justice in Albania will continue to be a mere facade, while crime and corruption will flourish in the shadows. /Infront-al.com/
