Even the Minister of Finance, Petrit Malaj, following the example of the Prime Minister, is disregarding the laws, issuing orders with content that serve to fill leadership positions for the favorites of the power elite and their friends.
With Order No. 153, dated December 16, 2025, Minister Petrit Malaj announced the launch of the process for the election of three members and the chairman of the Public Oversight Board, a structure that reports directly to him.
One of the criteria for becoming a member of the Public Oversight Board is this: applicants must not have close ties up to the second degree with persons who are part of the elected bodies of the statutory auditors organization.

But Minister Petrit Malaj, in violation of the law, has pretended to have "forgotten" to establish the legal criterion that applicants for members and directors of the Public Oversight Board are prohibited from having auditing businesses, as this constitutes a direct conflict of interest.
The Public Oversight Board is tasked with controlling the quality of auditors' work, conducting monitoring and evaluation, overseeing the implementation of testing procedures, and registering statutory auditors and audit firms, including imposing disciplinary measures against them.
According to the criteria set by Minister Petrit Malaj, in the competition to become a member of the Public Oversight Board, persons who have family ties to leaders of the statutory auditors organization are not allowed, but those who own auditing businesses are allowed.
Even Minister Petrit Malaj himself, the Director General of Taxes, Ilir Binaj, as well as their wives, parents and family members, own private companies with auditing activities, being in open conflict of interest with the high state functions they exercise.
Currently, a member of the Public Oversight Board is Adriana Berberi, who has an auditing business. Her husband is a specialist at the Sequestered and Confiscated Assets Agency at the Ministry of Finance; her son works at the Directorate of Accounting Experts and Auditors at the Ministry of Finance; while the son's daughter-in-law is the SP MP, Bora Muzhaqi.
Other Board members are:
– Dritan Fino, Director General of EU Funds Management at the Ministry of Finance;
– Martin Mici, General Director of Food Safety, Veterinary Medicine, Plant Protection and Fisheries at the Ministry of Agriculture;
– Luan Abazi, Economic-Finance Director and Secretary General at the General Prosecutor's Office;
all persons who have or have had auditing businesses.
That's how "independent" the Public Oversight Board is today, with members and leaders who hold positions of power and own auditing businesses.
