For the past month and a half, numerous State Police forces have been deployed in Baks-Rrjoll and are physically assaulting and arresting residents who are protesting to protect the lands they claim as their property, on which Bashkim Ulaj has begun building a resort.
In the face of this massive physical conflict, the Shkodra Prosecution and Court, the High Prosecutorial Council, the High Judicial Council, and SPAK are remaining silent, creating reasonable suspicion that they have sided with the police and Bashkim Ulaj against the residents.
The company "Gener 2" has cadastral documents for 150 hectares of land, purchased by citizen Fatmir Shpellzaj, while the residents of Baks-Rrjoll claim that the land is theirs and was stolen from them with false official documents.
They have filed a report with SPAK for false documents, blocking the work of the "Gener 2" company, and the removal of police forces from the area, pending a judicial resolution of the conflict.
The heads of SPAK have declared a lack of competence, transferring the case for investigation to the Shkodra Prosecutor's Office, when the complaint filed by the residents alleges the criminal offenses of abuse of office, corruption, falsification of official and cadastral documents in collaboration, and illegal gain of property.
The Shkodra Prosecution Office, in addition to the file sent to it by SPAK as subject matter competence, has several criminal reports filed by residents of Baks-Rrjoll with the same charges.
But the Criminal Procedure Code is not being applied, by not blocking the works of the "Gener 2" company until the investigation is completed and the final decision is announced; there is even inaction by the Shkodra Court, which does not secure the lawsuit until the case is adjudicated.
Faced with the inaction of the Shkodra Prosecutor's Office and the Court of Appeal and SPAK, which are clearly showing bias in favor of Bashkim Ulaj, the High Prosecutorial Council and the High Judicial Council must act, as superior bodies, because they are not just for appointments.
They have a legal obligation to demand explanations from the Prosecution Office and the Court of Shkodra and from SPAK, why the obligations under the Criminal Procedure Code for the investigation and trial of the "Rrjolli" case are not being implemented, according to the claims in the reports and court indictments filed by the residents.
The massive physical conflict of a month and a half forces the KLP and the KLGJ to intervene to force the justice structures to implement the criminal law, to ensure the indictment, investigation and expedited trial, because a dangerous situation has been created in Baks-Rrjoll.
The physical conflict between residents, the State Police sent by Prime Minister Edi Rama, and the private security forces, employees, and criminals brought in by Bashkim Ulaj is escalating and expanding.
